Thank you, I will format it better and put the appeal together with the photos and email from Berkeley Homes (this was the day after that I wrote to them but hoping that will not matter!).
I am still concerned about giving them my name and address because this is really what they have wanted all along and if POPLA do not uphold the appeal then P4parking will have my details to pass to their debt collectors. I may see if POPLA will just accept an email address as that is how they prefer to correspond.
Anyway thank you again, will let you know what goes on. I also hope this thread helps anyone else in the same position. I have certainly learnt alot and am feeling quite strongly myself about these companies now. I am almost tempted to park there again, just to annoy them :-)0 -
They will just get your address from the RK details from the dvla so it won't make an ounce of difference. Popla will not deal with this IMO without you first appealing to the parking company with your name & address , they (popla) will not deal with an appeal certainly without your details, email addresses are not your details.
This will not make any difference if they do know your address as the most you'll get is junk mail through the boxWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Oh, just thought, you could add in your POPLA appeal that you have not yet given a postal address because you do not believe this new AOS member, which is still in probation period, can lawfully obtain your registered keeper data from the DVLA. If P4 believe differently they must prove they can get data and describe to POPLA, how they get this data (EDI or paper application) and which third party they use, and is that via an EDI link, if so, whose link?
Say that you believe a third party debt collector getting data via EDI on behalf of a fledgeling PPC that does not have an EDI link yet, is not lawful and against the DVLA rules, so you have so far protected your address by using an email address only which you contend does not breach any rules, because you have provided an 'address for service' for the purposes of this appeal.
{remind me, did you email the DVLA and get a reply yet? Can a third party debt collector get the data via an EDI link on behalf of a new PPC who have no EDI link yet - if so why, what's the point of making such new members be restricted to paper applications if they can just ignore that restriction via a back door third party link? And what protection is in place at the DVLA to stop any debt collector from getting data for a PPC which is banned, then?}.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, Yes I did write to the DVLA, here is their reply (my email to them is at the bottom - mostly copied from what I was advised on here) Am just getting around to the POPLA appeal now:

I am writing following concerns I have relating to a private parking company, P4parking who issued my vehicle with a parking infringement notice last week. They are hassling me for my address and refusing to deal with my appeal until I provide it to them. For obvious reasons I am unwilling to do so, particularly as I consider the infringement notice to be unjust.
I have been advised to contact you to ask if [FONT="] P4 [/FONT][FONT="]parking can currently get my registered keeper data? I have seen information that suggests they've been using a third party to get the information so now I have one of their tickets I want to know if they are allowed, or banned, or what the current status is with that parking company please'. I am the owner/keeper of the car, and am not asking for my own data so my understanding is that I do not have to fill out a V888 nor pay a fee to get this information. Please could I be given an immediate reply if at all possible as P4 Parking are hassling me for this information which is making it look even more suspicious that they cannot get data themselves. This is what P4 parking had told me about using a debt collector;

I still would not give these scammers your address.
I think they mean they will get the debt collector to use their EDI link to get the data for them even though I think this company are supposed to be applying by paper application.
I would reply to the DVLA and say 'you have missed the point, I know that this bunch are listed on the AOS members' list but they are very new - so I am asking specifically if they can ONLY get my data by paper application? If they have no EDI link yet, then how can they lawfully pass the details of my car reg to a third party debt collector to use their EDI link? If they can do this, why, what's the point of a probationary period with no EDI link?'PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am going to send the POPLA appeal with an email address and then see whether they will process it without an address. I am quite loathed to give it to them when this is exactly what they want. If POPLA will only process with a postal address and the DVLA confirm P4 has no EDI link then I will leave it at that. I may however report them to the BPA regardless as they have not noted on the charge notice about obtaining info from DVLA (although it is on their sign post) or offered the 40% discount.
I am most annoyed that P4 have not answered any of the specific queries I raised with them and have been really un-proffessional in their responses. I guess enough people just pay to make it profitable for them and they don't need to waste their time dealing with appeals properly. Plus they consider obviously they are clearly in the right. I do not entirely dispute that I made an error but it was because the signage was misleading and the penalty excessively outweighs the "crime". Am rambling, will let you know the response from DVLA and from POPLA as it should be of some help to other foruminites.0 -
There is no need to be hasty. Assuming that you are the registered keeper of the car why don't you wait until P4 do have your address? They will get it from the DVLA in a few weeks time when you ignore the notice that was left on your car. They will then send an invoice to the registered keeper with the option of appeal to them & if that is refused to POPLA.0

After a very frustrating and long process of trying to email POPLA appeal and related photo evidence I have managed to do it but only by submitting on line via their website. Email would not allow any of the relevant attachments (which included the actual form).
However all the photos were too big to send on line too, taken with my windows phone. So I would advise taking photos with a regular camera (I think these may be "smaller") or what I did was put them as a montage onto a word document and then submitted. I had to reduce the size and fiddle around with it for a while but it worked.
I don't think I will win the appeal but worth a try, now I wait!0 -
You can send your appeal to POPLA by post. Only being able to submit tiny photos that may not show enough detail to be proper evidence would be viewed very badly if the case ever came to a proper court of law.0
