Parking Charge Notice-P4parking-problem with appeal

I received a parking charge notice from p4parking which I consider unfair. It was night and I was parked in a space marked for visitors, I did not realise it was solely for visitors to an on site office (on line agent to view the flats located on site) but regardless I checked later on and it was outside office hours and no staff were on site.
I appealed stating that it was a clearly marked visitor bay, the estate agent has stated there are no time limits to parking there and asked what the cost was to the landowner. I did not give name and address. They replied 2 days later and said if I did not given them my postal address within 5 days they would not deal with the appeal. I have asked why they need this info for the appeal and nowhere can I find anything stating this is necessary information.
I will ignore them if they say they will not deal with the appeal but on a matter of principle I would like answers to the queries I raised with them.
Does anyone know where it is stated that you have to provide your address?
Can you still appeal to POPLA if the parking agent refuses to deal with your appeal?
Can you ask for certain information under a Freedom of Information Request, i.e. the terms and conditions laid down by the landowner (it was breaching these of course that meant they issued the ticket).

    If you want to appeal to POPLA you're going to have to give your name and address sometime, so you might as well do it now.

    FOI does not apply to PPC's

    They want you to give them your address so they can save money asking the DVLA for it.
    If you do appeal they WILL reject it as they are only interested in your money.
    You have to appeal to them before POPLA will accept any further appeal.
    Just ignore them, they are obviously the lowest form of scammers by the look of their pathetic website I would imagine a 10 year old could make a far better job.
    You will get some regulars come on soon with more helpful advice, but you really are taking these chancers far too seriously!

    The answer is no as the FOI Act does not apply as the Freedom of Information Act gives you the right to ask any public sector organisation for all the recorded information they have on any subject.

    I would reply and say this is your validly served - and obviously received - appeal and you will be taking the matter to POPLA so they'd better accept or reject within 35 days or they will be out of time. If they do not follow the deadlines in the BPA Code of Practice they will be in breach and you'll report them.

    Say that if they want a postal address they can pay the DVLA for the registered keeper's address after 28 days, if they can manage to complete the form! If they are allowed your data, that will give them a few days to send their decision to you and a POPLA verification code if it's a 'rejection'. Remind them that they cannot allow a debt collector 'like PCS' to use their EDI link to get the data and you expressly forbid them to pass it to a debt collector to circumvent the correct data application rules...if they do they'll be reported to the DVLA. Say that they have been noticed on consumer forums as not getting data themselves and are already being reported by other people, so they might be well advised to cancel your fake PCN as this will be another complaint to the DVLA if they are true to form shown so far!

    The point being I think not only do they not yet have an EDI link to the data (suggesting they are still having to make postal applications to the DVLA as they are in the first 6 months 'probation period') but it seems that they are NOT even getting anyone's data themselves...for some unknown reason. Maybe they have been stopped for some reason...their name would still be on the BPA AOS members' scheme list - even companies that are banned stay on the list. Something fishy going on with P4P I suspect.

    It looks to me as if for some reason, P4P are not getting data at all. They are then letting PCS (part of Debt Recovery Plus, a well-known toothless debt collector) get the data for them later. That's not lawful, a debt collector cannot get data by EDI for a firm who cannot get the data for whatever reason.

    No wonder they are so desperate for your postal address. Something may be up with their ability to get data, who knows? I would not give them my address.

    I would email [EMAIL="FOI@dvla.gsi.gov.uk"]FOI@dvla.gsi.gov.uk[/EMAIL] and ask 'can P4 Parking currently get my registered keeper data? I have seen information that suggests they've been using a third party to get the information so now I have one of their tickets I want to know if they are allowed, or banned, or what the current status is with that parking company please'. State that you are the owner/keeper of the car, you are not asking for your own data so you do NOT have to fill out a V888 nor pay a fee to get this. Ask for an immediate reply as P4 PArking are hassling you for your postal address which is making it look even more suspicious that they cannot get data themselves.

  • Thank you to everyone for your help and assistance.
    I have emailed the DVLA and emailed P4parking again, advising them that I still await their response and am checking with the DVLA about some concerns I have in relation to their request for my address.
    I cannot find any information anywhere that says appeals cannot be dealt with unless my address is included and it really bears no relevenace to the queries I have raised in my appeal.
    Also from one of the links in one of the responses I received I noted that someone else had received a similar charge notice and that it was in an infringement envelope, as was mine. I am not sure if this is relevent but the envelope does clearly state parking infringement notice while inside it says parking charge notice.
    I know I should just ignore them but as a point of principle I want to know why they issued the ticket and at what cost it was to the landowner, also that they need to respond to the appeal. I dont really want to "let it drop". Obviously it would also give peace of mind if they confirm that they will not be proceeding any further or employing third parties to contact me.

    I have a response from P4 parking below regarding obtaining information from DVLA (I have asked them to email their correspondence -if they accept email appeals they should answer via email);

    They can get it themselves as they are in the BPA AOS, so they are not breaking any rules in place. They just want to save money by you giving an address of service. I would go the popla route
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
