Enforceing covenants will be very hard to do.
land registry, council will not be interested.
AIUI it is the person(s) that benifits from the covenent that needs to enforce.
eg the not running a business is often put in by developers to protect the image of the estates while they are trying to sell, once they complete the estate they don't care.
if ex council house then the council may have put in a covenents which could try,, they will be in yours so why not just check them.
(the various covenents I have, can't make glue, manufacture munitions, keep chickens, also responsible for upkeep of a well that no one know where it is)0 -
Just to confirm that the land register will often record covenants against a title but Land Registry has no involvement in their enforcement. That would be a matter for the courts if you decided to take it that far.
The example cited by getmore4less refers to how a developer may often include covenants in the terms of the Transfer (sale document) for each house/plot. The benefit of such covenants run with the land i.e. the development and as such the developer would only normally retain a benefit if they retained part of the land in the original development.
As each plot/house is sold then the benefit of those covenants is effectively passed to each plot/house i.e. their registered owner and the covenants would be there's to enforce - proving that you have the benefit of such covenants would be important if you chose to try and enforce them.
You can check the land register for a property online but if the house was part of a larger development it is the first Transfer of the plot/house by the developer to the first owner which is likely to be of most interest - this can only be obtained by way of a paper application. That process is explained in our FAQs
