  • It sounds to me like you probably have a valid claim, however only you can decide whether it's worth your time and effort to pursue it further.
  • I have now had another email from Swissair saying: Thanks again but we have apologised - sorry for the delay, nothing we can do. Has anyone had any dealings with Bott and Co for claiming? I am a bit frightened about going to small claims in case I do lose - have read somewhere that airlines can throw a lot of money at these things and then I might be liable for costs!! Can anyone help me out here or should I go to the court office and find out?

  • I was due to fly back by Aer Lingus Dublin to Manchester on Friday - got an email a couple of hours before the flight, saying it was cancelled. I had to ring and re-book for later in the day. I arrived back in Manchester 1hr 50 mins later than originally scheduled. I am unclear as to whether I can claim for compensation - I have read the resources but it is just not very clear to me (my fault probably).....can anyone help me on this?

    Regardless of the reason for the cancellation you will not be able to claim because you did not arrive more than 2 hours late.

  • On 17th Feb my flight from Cardiff to Paris was cancelled. I was rerouted through Bristol and arrived in Paris, at the wrong airport, 7 hours later than originally scheduled. I wrote to Cityjet and asked for compensation for cancelled flight plus airport shuttle and extra parking costs.

    I received the following reply: "The reason for cancellation was an air pressurisation issue on the aircraft, discovered on the previous sector, therefore as per eu law 261, any technical fault discovered upon arrival/departure means the airline is not liable to pay compensation."

    I wrote back quoting the following case: Joined Cases C-402/07 and C-432/07
    Christopher Sturgeon and Others v Condor Flugdienst GmbH
    and Stefan Böck and Cornelia Lepuschitz v Air France SA which states:


    The fourth Chamber also ruled that under the definition of "extraordinary circumstances", technical faults within an aircraft should not be included and therefore an air carrier cannot rely on a technical fault within an aircraft as a defence from a valid claim under the Regulation.

    They have replied saying they will pay for my parking and shuttle but no compensation.
    What should I do next? I'd be really grateful for any advice.

    If cityJet are registered in Dublin, perhaps read about the ESCP in the ryanair thread.

    Thanks to 111KAB and richardw for your advice.
    I have found European small claims forms and will reply to Cityjet telling them I will pursue this further. I'll wait for their reply and then if necessary fill in the small claims forms.
