Finally got a determination from ADR on my dispute with Emirates , total crap
"I determine that the reason for the delay, namely an air traffic control restriction which was a result
of adverse weather condition in Manchester as cited by Emirates does amount to an extraordinary
circumstance in this case.
Emirates has provided confidential evidence in the form of a flight operations and METAR reports
which demonstrate that flight EK018 arrived at 02:16 on 31 January 2019 at Dubai International,
due to an weather delay on departure which caused an initial delay of one hour thirty-nine minutes,
and Aircraft Rotation which caused another delay of eighteen minutes on departure in Manchester,
which resulted in a total delay of one hour and fifty-one minutes on arrival.
Mr Aspinall is denying the reason of the delay was due to adverse weather condition. He states
that the delay was due to . However, he has not
provided any evidence to prove that a longer boarding process has caused the delay to flight
EK018.
I have also reviewed public websites, as demonstrated below, which highlight that the adverse
weather was present on 30 January 2019 in Manchester and that Manchester airport imposed a
runway closure which is an operational decision of the Air Traffic Control which not only affected Emirates flight EK018, but also flights with other airlines:

Viewing the above, I am satisfied that the cause of the delay of Mr Aspinall
to an air traffic control restriction and, as such, the airline can rely on the delay being caused by an
extraordinary circumstance within the context of EC261/2004 as their defence in this case. I consider that due to the on-going adverse weather conditions and Air Traffic Control restrictions,
the Airline was constrained and limited in the options available to them in order to limit or avoid the
disruption to the Flight. "
First time ATC restrictions have been mentioned , what ongoing adverse weather ,it was a beautiful fine sunny afternoon ,the bad weather had passed hours before scheduled departure ,OK there was only one runway open but with the amount of air traffic around i would have said it was more than adequate.Why is their evidence confidential, it could be any old tosh im not allowed to challenge. Maybe time for Bott's, i presume they will be able to find out if there were ATC restrictions at the departure time and if other planes were leaving near their scheduled time.

Thats unlucky imo.
Unfortunately it's just one of the vagaries of all the ADR companies. The adjudicator obviously did not examine the time line very well.
Botts are a good option now, or MCOL which is stressful and time consuming but do-able.

Thanks Tyzap ,will give Botts a ring tomorrow , i just can't see how they could still blame the weather , and the only ATC restriction would be you can't use runway 2 because its still got snow on it0

Hi.
I have an ongoing claim with Air Maroc for a delayed flight; the case was opened on 23rd Jan.
It feels like they are happy to keep it on hold since I never get any replies from my emails and when I call they tell me the case will be resolved soon, even though this has gone on for months. They aren't able to give me a fixed date on when they’ll be done. Sometimes they’ll tell me it should be completed the following week or if nothing has changed to call in, even though I've told them I've already called several times over the course of over half a year.
I'm not sure what to do since it feels like this could continue indefinitely.

Have they even agreed to pay you? If not then it is time to give them 14 days warning that you will begin legal proceedings. I assume this is for a flight from the UK as the rules would not apply on the return flight from Morocco?0

The flight was from UK yes.
I haven't seen an agreement in writing. Just an email saying they opened up a case, then a week later they sent me this message at the end of Jan:
We have attentively received you email.
Besides , in order to enable us to reply to your complaint, kindly send the travel documents concerned (ticket number, booking reference, boarding pass ...).
I gave them all the necessary docs 5th Feb then never heard back even when I emailed a few times after this. The first time I called I think was 25th May and they said they hadn't received the docs so I emailed them again.
Since then Ive called about 4 times. Today I emailed them to see what was happening and they replied almost immediately with the same message I've shown above about needing certain docs, so I've sent them again.
For the 14 day warning I think I still have my resolver case open; would it be best to use that as a guide to escalate?

The flight was from London to Sao Paulo with a stop over in Casablanca.
