    Hello

    I am totally confused, would some one be able to guide me in the right direction. I started a claim for my dads bank charges on 24th May using moneyclaim online.

    We were sent a letter saying the bank have until 12th June to reply. The bank then acknowledged the claim on 11th June. We havent heard anything since.

    Are we now able to start a judgement?

    Issued - 24th May
    Deemed Served - 29th May
    As they have acknowled they have 28 days from the day it was deemed served to submit a defence.
    So deadline being - 26th June

    What does it say under 'status' of the claim on MCOL ? You should either be able to request judgement or it will say you can no longer proceed online in which case they have entered a defence and the claim will be passed to your local court for a hearing date to be set,

    Hi
    I think the 28days were up yesterday so you should be able to press for judgement now . have you checked your bank account to see if any money has been paid in as nationwide like to do this by reading other threads.
    Hope it all goes well for you i have 11days left befor i can press for judgement and they all seem to last forever.

    Yes you can start judgement now if it was issued on 24 May. The date the bank acknowledges does not matter to the overall timeline, it just gives them 14 days more overall, but not 14 days from day of acknowledgement but 14 days more from day of issue!

    Just click that Judgement button before the bank files a late defence!

    Did you go for judgement or look at bank account to see if anything paid. call the court or mcol in the morning they will explain what you have to do .

    no money is in the account. So i am going to start judgement.

  • i have followed all the info regarding the letters and the time scales and i even used money claim online and because the halifax havnt replied within 14 days i asked for judgment to be awarded to me by default and when i came home today went online to check how it was going on money claim online and it says that my judgment has been regected and i can take no more action with claim money online.Whats going on i was told that if the bank hasnt been in contact within the 14 days that i would be awarded by default.So if anyone knows how this works please let me know.Anything would be great.thanks
