    Right well today was the last day the Nationwide could acknowledge my claim before I start judgment, and they did it today!

    So how long do I have to wait now before the next stage?

    The claim was issued on the 7th June, deemed served on the 12th, and had to be acknowledged by 26th JUne, today.

    I think it is 28 days to file defence, so is it 28 days from 7th June, 12th June or the 26th?

  • its 28 days from the origanal date of issue
  • they have another 14 days from today so a total of 28 days. i had the same with lloyds with who i have two claims on the go, with one of my claims with them they put in a defence but they only acknowledged the other so after another 14 days they had done nothing so know i have technicaly won by default.not had any money yet though but it was only last tuesday so will give them abit longer

    err its neither!

    MCOL allow them an extra 5 days on top of the 28 days! This is to allow for delays in the post and their own administration to catch up!

    so thats 33 days after you started the claim (or the next working day if thats a weekend!)

    Not the date it was DEEMED served which was the 12th?

    can i just ask about mcol costs, i had been lead to believe that the costs were between 30 and 130 pounds but i have put my claim in for £4824 plus interest to take it to £5725 and costs come up as "250 ,is this right please

    morning all, i filled and paid for my online claim on the 22nd june, ive had confirmation from northampton that my claim was issued on the 25th, and that halifax have upto sunday 14th july?

    is that correct that seems alot of days,?

    also assuming i dont here from the halifax can i ask for a judgment on a sunday?

    your thoughts please

    After Money Claim Online issue your claim, they allow 5 days for it to be served. The bank’s solicitors then have 14 days to respond. However, their response can be just filing an Acknowledgement of Service. If they do this, the 14 days is increased to 28 days. If the deadline expires on a weekend or Bank Holiday, they get the Monday or Tuesday respectively.

    If they file a defence, the claim will be transferred from Northampton </ST1:p(where Money Claim Online are located) to your local county court, who will either send you an Allocation Questionnaire or set a date for the hearing. If they don't file a defence and when the deadline expires, you can apply for a judgement by default on the Money Claim Online website.
    The acquisition of wealth is no longer the driving force in my life. :)
