    I am not saying you are making anything up but the act does say that after 6 months the onus is on the buyer to provide evidence.

    If you pull out a V5 as evidence, which only proves the previous owner not that it was misdescribed and you have had that evidence for 12 months, why didnt you say something straight away

    I would be peeved like you are if i didnt know, but not sure I would blame anyone but myself, 12 months down the line

    I think I'm just going to have the car flat and polished and take the money. I've had the car 12 months I've been careful with it and I know what it's been doing for the last 12 months rather than going trying to find another car that I will be happy with as I am really fussy about cars.

    I meant the poster who is telling you to go to court, it seems he just cancelled his contract before completion of purchase from AC and they refunded him, of course he may have gone to court and won a different case

    Who said anything about Arnold Shark?

    Anyone with enough knowledge of Consumer Law can do the same.
    You can even start County Court proceedings online, it is very easy to do, and you don't need a solicitor.
    I would recommend it to anyone.

    Anyway, The Law is The Law.
    Any car dealer cannot escape that fact.

    If you have the time (and are inclinded to do so), why don't you visit another local bodyshop (different to Arnold Clark) and see what they advise about the paintwork issues.... they may have a different solution to the problem, and you could then go back to Arnold Clark and try and reach a compromise with them (depending on the cost of course).

    Ive only had one dealing with Arnold Clark, we put a £300 deposit down on a nearly new (less than 6 months old) low mileage (advised it was 1,000 miles) Fiat Punto a few years ago, they were getting the car transferred to our local Arnold Clark, but a couple of days before we were due to collect the car, they called to advise that they had the car but there was a problem with the mileage (it was actually 12,000 or so miles), slightly more than the 1,000 it was advertised and confirmed when they telephoned the other branch to make sure that the car was still available.... they offered a few hundred quid off or our full deposit back - we chose the deposit back which we received in a couple of days.... so no issues with Arnold clark.
