Flight delay and cancellation compensation, KLM/AF ONLY

As a regular at LBA I agree the first KLM (0620) is often late, the reason/excuse being that flight the night before was late arriving, as they may delay its departure from Amsterdam to catch late arriving passengers from other flights and avoid paying compo and overnight accommodation and the pilots are required to have minimum rest before they fly again the next day. Whether there is a grain of truth in the explanation or whether they just like an extra 30 minutes sleep in the Marriott Hotel I am not sure.
I don't think there is any chance of a transfer to AF for the very good reason they don't fly to LBA and they certainly won't put you on Jet2.com0 -

Looking at flightaware, the previous evening flight have all arrived within 10 mins of ETA, apart from one that appeared to have done 6 loops around LBA for 20mins on bank holiday Sunday.If you're new. read The FAQ and Vauban's Guide

We flew in 2011 and were delayed in Paris for 24 hours due to having no pilot!
Have claimed AF say burden of proof is on us.
We have all our original docs except our boarding passes.
Is this worth pursuing?0 -

On the basis of the informatiomn provided, yes, it is worth pursuing.
You don't need boarding passes - especially if you have other evidence that you were on the flight.
If you were on a flight delayed for 24 hours, the burden of proof is on them to show why the Regulation doesn't entitle you to compensation.0 -

We left las vegas at 1325 on the 4th sep on a through ticket via atlanta and amsterdam on to Norwich
we had a 2 hour window in atlanta and a 50 minute window in amsterdam this was as per KLM ticketing bought direct from them.
there was confusion at LAS as they couldnt see we had checked in and the same at Atlanta.
It turns out the schedule had been changed after we checked in at T24. we should have been on the 1325 from Amsterdam to Norwich but it had been changed to the 1650 AMS to Norwich.
we have also got no bags as the baggage receipt has the wrong flights on it (has the original flight)
do we have a case for a schedule change with less than 24 hours notice or denied boarding ( we would prob have missed the 1325 departure from amsterdam anyway) we ended up 3 hours later than originally sheduled at Norwich ( 4 hours after filling in missing bag claim)

Given that you originally had 50 mins in AMS, 12:50 arrival, 13:40 departure, and there was no flight cancellation, I am wondering whether the schedule change to your booking was made by KLM as they knew the ATL-AMS flight was going to be delayed leaving you with less than the minimum connection time. (I can see that it arrived 25 mins late at 13:15 so there was only 25 mins)
I doubt you would get any comp for denied boarding as you would not have been able to present yourself at the gate at the required time so this will be for a delay resulting in an arrival at your final destination of over 3 hours (original arrival time at Norwich 1:35, actual arrival 4:36 so should qualify for €300 assuming the delay from ATL was within KLMs control)0 -

KLM did say that the late departure of our ATL-AMS flight was due to its late inbound arrival due to a small technical problem, does that mean it was within KLMs control.0 -

In that case it looks like you can make a claim based on arriving at your final destination over 3 hours late (€300) Examples outwith the airlines control are things like weather and ATC.
The delay on the inbound flight explains why they changed your flight from Amsterdam to Norwich as they knew well in advance that you were going to miss it so were protecting you by booking you on the next available flight. Had the inbound flight not being an EU carrier then you would not have had a claim but since it was KLM you can send off your claim (I would keep it simple based on - due to the late arrival of the ATL-AMS flight the connecting flight was missed and the replacement flight got you to your final destination over 3 hours later than scheduled...saying your AMS-NWI was rescheduled just confuses things as the flight was not rescheduled, it still operated but you missed it because of the delay)0
