    i filled out the online form on 3rd october, still awaiting a response (i recieved the standard email to say they will look into my refund request).
    I sent a follow up email on 1st january. still nothing..
    any ideas if it should take this long, or the next step?

    You should give them as much time as you personally think reasonable. And if you have had no adequate response by then, write a Notice Before Action letter (as per the FAQs) giving them a further 14 days before you start legal action. And on day 15 ...

    Hello, I wrote to AF with a claim for a missed connection at CDG back in 2011 due to the delay of the first flight from LHR ro CDG. The total delay to my final destination was over 24 hours, and the flights were booked on the same ticket with AF.!

    AF has responded to say that the delay was due to security measures and are extraordinary circumstances. When asked for further information (as I don't think all security measures will automatically be deemed as EC - but do correct me if I'm wrong), this is what AF stated:

    "There is no need for our company to offer details of the cause of a delay in situations where the airline cannot be liable."

    Is this correct? It seems a bit back to front to me. without the details it would surely be difficult to establish whether it's their fault? or will ALL security measures mean that the airline is definitely not at fault?I have read the faq and could not see anything on this so wanted to check that they are not fobbing me off! the fact that they are refusing to provide the details has made me more suspicious.and if they might be, can I write to the caa for more information?

    You can write again, but the truth is only likely to come out when you take them to court.

    A security incident could well be extraordinary - indeed, it is likely to be. But they would still need to show that they had one everything possible to minimise your delay to avoid paying compensation - and a 24 hour wait would make that very hard, in my opinion.
  • It's in the FAQs to which you have been directed on at least 2 occasions before in response to your posts! :mad:

    But you should also be aware that KLM are likely to ask for a legal stay if you commence legal proceedings since the Huzar judgment itself has been appealed. It is not precedent case law anyway so you can still start a legal claim and just make no reference to the Huzar judgment.

    It's easy when you are presumed to know how but not so easy when actually you don't! :mad:

    Getting compensation is far from easy and takes time and tenacity, investing time in being bothered to find the FAQs is a good start.

    I am afraid Richard is right. If you can't work out the basics, including where the FAQs are on this forum, your chances of mastering the Regulation and all the process of a claim are not going to be great.

    This stuff, regrettably, is made hard by the airlines. And if you're not up for it, instruct a NWNF lawyer or let it drop.

    This may sound harsh - but it has the merit of being true.

    Well I have submitted my claim for compensation via MCOL!
    Will see what happens, and am busy reading up on the court thread

    Does someone know if when applying for compensation you can claim for your baby too?

    we are asking for €600 each for a +20hr AirFrance delay accross continents (Paris to Mexico).
    we paid £1070 for each of us and £70 for our son.
    how much should we ask for? if we go by % it would be ~€33, which doesn't cover the inconvenience of being delayed with a baby!!
