Read the FAQs on page on of this thread and then decide what you want to do next: take them to court yourself, appoint a no-win no-fee company to take this on for you (for about 30% of your award), or walk away. Lots of reading for you to do, I'm afraid, if you want to take further.
I thanks for this. I have read through and cited the relevant cases to AF. Below is an extract of their response:-
"In the opinion of Air France, indeed a technical problem cannot, by definition, be considered as an `extraordinary circumstance'. A specific problem, that is encountered unexpectedly, which presents itself beyond our scope of influence and is a threat to flight safety, can nevertheless be regarded as such, even when it concerns a problem of a technical nature.
Having double-checked our records, I can confirm that your flight was delayed due to unexpected problems with the fire seal on engine 3 that encountered unexpectedly and is a threat to flight safety. An issue like that can be regarded as an extraordinary circumstance. In that respect, I must respectfully decline your request for compensation based on article 5.3 of the EU regulation."
Is my only option to take take legal action now?0 -

An unexpected problem remains just simply that, it's still inherent in the day to day running of an airline where planes have a high degree of technical sophistication.
NBA and then court for you.0 -
Sorry, but what is this NBA?0

It means Notice Before Action, and is written to inform the other party that you intend to commence legal action within a definite notice period. You need to write such a letter before you can take the airline to court.
However, the fact that you ask this questions suggests you haven't done much reading around this issue - including the FAQs on page one. If you don't put in the hours to understand the law and the process, you're unlikely to make much headway. And though folk here will be helpful, they won't spoonfeed you either.0 -
The FAQ's, that are a sticky, and are also posted at the start of each specific airline thread, have a dedicated section of explanation of NBA as well :undecided

It's certainly becoming a little tedious the repeated questions. Sorry Hairy Hogg, not having a pop at you. It's on every thread now.
What is NBA.
Do I have to accept vouchers or can I ask for cash.
Thomson say that I have to claim within 2 years, is this correct.
etc etc0 -
Hi all, after several months of silence from KLM regarding my claim for myself and my family I'm posting my NBA to them today. Will update you all when I hear anything!0

Hi I could use some advice
Currently in Amsterdam airport after flying from LAX. We are heading to London heathrow.
Our plane in LAX was delayed by 1 hour resulting in us missing our connection here in Amsterdam .. We have been put onto the next available flight in just over 4 hours time.
So our total delay by the time we land in London will be about 4 and a half hours. After rreading some of this thread am I correct in assuming we could be entitled to up to 600euros compensation each?
Many thanks for the help0 -

It depends on which airline (the actual plane not necessarily the code on the ticket) that you flew to AMS with.
Was it a KLM or a Delta aircraft0 -
