    Thanks, I was unsure if there was a set letter/format I should follow. I will write and phone. Not walking away . . . .
    It took 6 months for them to respond with the usual rejection letter.

    Really? The triumph of hope over expectation (or the experience of 95% of the people on this forum). Don't waste time writing letters - take them to court. Look at the experiences of others on this thread to guide you.

    I'd say contact them because they are trying to drag it out! I had the same problem however I waited until the 12 weeks was up then I wrote an email to them via the Virgin websites contact us link. I said that if they fail to answer me within 14 days then I shall consider taking legal action. I got a reply in the post 2 days later saying the usual "extraordinary circumstances"

    It took them ages to reply to us as well but I thought I had got the dates mixed up but in total I think we waited about 20 weeks for them to get back to us with the usual Extraordinary circumstances but if u read back through this thread, u will see that they are sending everyone pretty much the same letters ... I have to admit I wasn't keen to take it to MCOL but its pretty straight forward so don't be put off, the way I look at it is that we don't have anything to loose and we lost a complete day off our childrens first abroad holiday to Florida which Virgin Holidays didn't care about!!

    Good on you, DM. This is the kind of attitude we should all be showing. Take no [EMAIL="!!!!"]!!!![/EMAIL] from the airlines: they are in the wrong and are wriggling on the hook. Show them you mean business, and fight for your rights in law.

    Fortune favours the brave, and in this case you have right on your side as well. Vauban says "Let Us Go Forward Together!" (which, for those of you who know who Vauban was, is quite ironic, actually).

    Hi thanks for the advice.

    I haven't recieived a reply to my email complaining to VA and demanding compensation. Should i wait a few more weeks or should i send a claim letter off now?

    Also, im not sure what i should be claiming for - cancelled or delayed flight? My first flight was cancelled and i was put on one leaving 4 hours from the original take off time but then this was delayed by almost an hour...

    I got my second rejection letter from VA.

    Points added are..
    The defect on this particular flight was not "intrinsic" to the normal maintenance process.
    Having reviewed the reports pertaining to this particular flight I can only reiterate the explantion given to you...
    So again they say no for compensation.

    But hang on, the letter seems to state that "my" flight was the one with the fault.
    No it was the previous service. Grrrrr!

    Have now put together lots of information including the fact that VS36 was cancelled the day before which according to the tweet from VA was due to form our flight.

    So do I give CAA a chance, sending all the letters and seeing that those who where on VS16, the return of VS15, have been compensated or go straight to MCOL and claim everything including interest?

    I know what I feel...

    It has now been over 15 weeks since receiving my first letter from Virgin saying they'll respond in 6-12 weeks, what do I need to do now? Any advice would be appreciated :)
    You can try contacting them again or just sit back, be patient, prepare your NBA letter and gather as much other data as you think may help your argument.
    I have just received a standard rejection letter after 19 weeks of waiting which now makes it two claims both rejected on the grounds of EC caused by problems with an earlier flight. Within the next few days Virgin will be receiving two NBA's pointing out that EC's only relate to a particular flight on a particular day and that I shall go to court if neccessary.
  • Hi there I've just filled in the claim form off virgins website as we were delayed by more than 5 hours on 2/06/2008 - orlando to manchester so I bet our flight been delayed was what had a knock on effect to your flight. I'm not feeling confident about a positive reply from them after reading things on here :-(
