    Great result - well done. Make sure you post on the Court Success Thread. I think you take the total to 19 successes to 1 fail: which is a success rate of 95% for taking the airlines to court. So what are you waiting for, people?

    Clearly, the taking of court action is the only way to achieve a pay out. ;)
  • We went on our honeymoon in April 2013 to St Lucia with our two young children (3 years and 10 months) we had a letter two weeks before the flight stating our flight time had changed to three hours earlier on the day of flight so we now had to be at the airport for 4:30am, we were travelling from liverpool but flying from heathrow, therefore we had to travel to london the day before and stay over in a hotel. We were not told that we would now be landing at Antigua to drop people off and refuel. During this time we were not offered any refreshments abd the children were very restless. We were told that Virgin had merged our flight with the flight we had been changed to as the aircraft wasnt full and they always knew that this flight would stop. Virgin are basically telling us tough we cant offer aby compensation!?? Any ideas where we stand or if this has happened to anybody else?

    Hi Lil_Me Can I ask how you decided on the date from which interest would be accrued....was this the date when you first lodged the claim with the VA itself?

    Same here, I have just started my MCOL claim. It was clearly obvious they were not even reading letters I sent via post/email so I used social media (fb) to query this very poor customer service and guess what.....the guy on fb sent me the same standard email detailing instructions on how to submit a claim :T

    Received cheque from Virgin this morning for £2120!

    Timeline:

    01/02/13 Claim form sent to Virgin
    08/02/13 Claim rejected - Extraordinary Circumstances
    14/02/13 Further letter to Virgin rejecting their interpretation of EC
    03/04/13 Claim again rejected
    11/04/13 NBA issued
    24/05/13 Claim issued through small claims MCOL
    04/06/13 Virgin acknowledge with notice of intention to defend
    13/06/13 Cheque received with letter

    I am happy with the outcome having paid c£10k for 4 upper class tickets and having lost a whole day of our holiday. Its a shame I had to take them to court to get them to settle.

    Nope, calculated from the date of the flight up to the date I submitted the claim which was just under 5 years - a pretty penny at 8%!

    Keep on going anyone who thinks it is too hard. The law is on the side of those with rightful claims. Use the excellent advice provided in these forums(thank you all that have posted) and hold the airlines to account. Do not let them scare you off.
    I will post more details of interest when my payments have cleared,that may be of use to others.

    You say CAA wrote what did they actually say?
    Also how did Virgin address the final settlement?

    Its really good to hear that peoples claims are getting settled .... I keep checking our page on the MCOL website and today it says ...
    Virgin Atlantic issued an acknowledgment of service on 13/06/2013 .... Any ideas what this means?

    I also wasn't sure if I did the right thing in claiming for the interest as it seems to be a lot more on top but thought I would try so looking at the past posts, Im glad I did ... it amounts to interest for nearly 5 years ... I will be delighted if it comes through but please keep your fingers crossed for us xxxxx
