Anyone trying to get compensation on VA flight Manchester to Orlando 03/06/08. I've just had the usual EC rejection letter as it was technical problem with bolt for fuel pump on an aircraft at gatwick the previous day.
We had 4hr 22 delay.
We have now sent a NBA letter to VA.
Hi there I've just filled in the claim form off virgins website as we were delayed by more than 5 hours on 2/06/2008 - orlando to manchester so I bet our flight been delayed was what had a knock on effect to your flight. I'm not feeling confident about a positive reply from them after reading things on here :-(0 -

Hi there again, just done some checking on flightstats and it must have been our flight that had a knock on effect to yours as I've just checked all flights that left Manchester to Orlando on the 2/6/2008 and they were all on time so it was flight vs076 due to depart on 2/6/2008 that was delayed over 5 hours.0 -

I doubt you will get a positive reply too, unfortunately. But if you start legal action, Virgin don't seem to have much of an appetite to stand their ground. Settling out of court for the full amount seems to be what they do when you push it all the way.0 -
I have today spoken with Virgin and informed them i am about to start court action. I have not received any response at all to my application for compensation or to my emails and NBA. I have today been informed the delay was due to a technical issue but the lady i spoke with was very reluctant to give me any information and either couldnt or wouldnt expand on technical issue. Is this enough to start court action with or should i hold off until i receive an official explanation? We are 18 weeks into the process.0

If you sent them a notice before action and the deadline has passed then you are free to commence a court action.0 -

Thank them for the air miles but also tell them that you will still pursue them for statutory compensation under EU regulations.0

Yes it definitely was. We knew the flight was delayed by 1 hour before we'd even arrive at the airport, but the plane was there at the gate at the time we'd expected. They let us all the way through to the gate before they decided that the plane had "gone technical" and we were sent back through to departures.
