Hi I tried to claim because we were delayed nearly 5 hours Back in June 2010 flight number VS75 Manchester to Orlando. they said it was because the plane got damaged during the removal of the aircraft steps in Manchester.
Do you think I can appeal ? We had to drive in pitch black too instead of day light once we eventually got there,not happy.

Hi, I logged 2 claims against VA from Euclaims (Bott & Co). After persistent chasing, I was advised of a judgement in my favor in one of the cases by Bott & Co in Nov 2013. Payment was advised in 42 days. Till now, there are no signs of payment (24 days on top of 42 days). I was told by Bott last week that the airline has not paid up and they will chase but might need to enforce!
Has anyone else faced this issue? How long do VA actually take to pay up?0 -

Well I think 42 days is excessive and indeed it appears when the airlines have their back against the wall they suddenly realise there is a payment system known as BACS. You are in good hands with Bott & Co however I would be insisting they put Virgin on 7 days notice to pay otherwise Sheriff/Bailiffs be appointed. Virgin will delay payment as long as they can get away with it. In my court case Monarch asked for 21 days to pay to which the Judge said no - "you can do that in 14 days now get on with it".0 -

We flew back with Virgin from Antigua to Gatwick in January 2013, the plane developed a fault (with the flaps on the wings) after taking off from Barbados on its outbound trip and had to return there. We were delayed for over 24 hours and, although Virgin did arrange overnight accommodation and paid towards the additional costs we incurred for meals, we each had to take an extra day's holiday and incurred additional petcare costs.
We made an initial claim to Virgin, which they of course rejected immediately, and so took it to the CAA. Today we finally received a response, stating that they had investigated and concluded that the fault was beyond Virgin's control and unavoidable, so falling under the "Extraordinary Circumstances" exception to EC261/2004. They therefore conclude that we are ineligible for compensation, and advise that, whilst we could pursue it through the County Claims Court, our chances of success would be low.
Has anyone else had this experience? This seems to suggest that any fault with a plane is ineligible so how do the airlines ever have to pay out?0 -

The consistent advice on this forum from the more experienced posters is not to involve the CAA. If people nevertheless do this and hobble their prospects of a successful claim, then that is a decision for them.0
