As Coby and I said - get on with it now but make sure everything is completed correctly. Are you going N1 or MCOL as this can make a difference as to when Virgin receive the papers?
I filed at the last minute at the local court but obviously ring first and check that you can and when. With time not on your side you need to get everything spot on. You have some work to do this weekend!0 -
Hi all, long time since I last posted on here, but glad to report success.
I passed the matter to Solicitors (DWF) via the a Legal cover on our home insurance policy.
They have reiterated the points I made originally and Virgin have agreed to pay without prejudice. 4 passengers @ 400 Euros each.
Flight was Gatwick to Orlando on 25/05/09 VSO75.
I'll post on the success Forum once I get the cheque.

Apologies, it was 300 Euros each, not 400. Delay was less than 4 hours, but more than 3. I've asked about interest on the amount claimed, is it standard that they should pay interest too, or are there conditions attached to claiming that?

To the best of my knowledge, you only get interest if you took legal action and claimed interest as part of that. Even then, it is at the complete discretion of the judge. If you are paid out by negotiation before reaching court, it's whatever you agree.
If you are paid out without taking legal action, my understanding is that there is no entitlement to interest.0 -

I thought that might be the case, thanks for the clarification.
For anyone reading on here who isn't prepared to pursue the matter themselves, well worth using the legal cover on your home insurance if you have it. It means that you don't have to pay any of your claim to the acting solicitor. The costs are covered by your policy.

My family & I were delayed 5 hours in 2012 from London, Gatwick to Montego Bay, Jamaica. We were informed at the time that it was a technical fault with the plane. I have sent in a claim form printed from the Virgin website & I have today received a reply from Virgin stating that they do not feel they have to pay compensation as it was an Extreme Circumstance. The Exhaust nozzle had to be changed. The delay was very frustrating as we had our 2 very young children with us, 2 & 5 years old. The delay meant that we arrived at the hotel in Jamaica at about 1am.
Is there anything I can do to take this further?
