    I can see Vaubans dissection of the chronology of events reining DavidW, should you decide to take it to court.
    Yes, Virgin were initially at fault, but not at fault long enough to warrant a claim under EU261. The weather was the ultimate reason for the final delay.
  • Not sure if this is any use to anyone, but I have just found a Virgin site that shows stats for all Virgin flights.

    It shows confirmed departure and arrival times as well as the scheduled times.

    It may help those trying to find out how long their flight was delayed and if they are entitled to compensation

  • I recently settled via mediation for VS016 22.06.13 (27 hour delay.)
    Not the full amount but sufficient to avoid a day off work and the associated hassle.
    As always don't accept the first offer.
    Thanks to every one who posted and the mods for their input that gave me the confidence to give it a go.

  • Hi all,
    I was lucky enough to have had a holiday to florida, which was delayed for 4 + hours.
    I put in a claim, although initially rejected, CAA got involved and I got a cheque for £250 each (which is a 3 hour delay). I assumed they believed the flight must have been 3 hours delayed, as I had no proof. My friend was on the holiday/flight with us (seperate booking, just a coincidence!!). So as a good friend I told her of the payout, and she claimed, and got a cheque for £500 each (total of £1500 for 3 people, I had 3 people and got £750). So my question is, can I contact Virgin and ask for more? as I have proof they paid more? or as my cheque said 'full and final settlement' I cant do anything?
    I just cant believe two different payouts for the same delay????
    any help would be gratefully received.

    What does their letter say? Did they offer you this in accordance with their obligations under 261/04, and if so did they explain how this amount was reached? Or did they dispute that compensation was due and offered to settle with you for a compromise amount. If so, did you agree to this? Have you cashed the cheque? When did you do so?
  • Hi, yes they quoted that, and didnt say how they reached their decision, just 'in accordence with ....'
    I have cashed teh cheque as it was last year, about nov and as I had to fight to get the cheque I was pleased they paid out. However, im baffled that I got a lower amount that my fellow passenger on the same flight!!! the letter did say if I cash the cheque its a full and final settlement, but it does seem so unfair.

    Well you have left it some time to claim the remainder - but you could write to them and query the amount. You might also ask them for how long they believe the flight was delayed for. Have you tried looking on flightstats? What was the flight number and date?
  • First time on a forum so please be patient with me.
    I think I have come to the end of the road with my claim. I wrote twice to Virgin stating a 4 hour delay from Manchester to Orlando back in 2007. They rejected my claim both times due to 'extraordinary Circumstances' due to a fault found with the aircraft Rudder Ratio, reported during the inbound flight from Orlando.Engineers replaced the Upper Rudder Ratio Actuator however they state weather hampered the remedial works. We were watching the repair and under no circumstances was the weather bad. we have photos to prove that. Along with our rejection letters we received rejection letters for two other unknown claimants flying to Las Vagas also stating rejection due to 'extraordinary circumstances'!! I then emailed the CAA to see if i had a case but they said it was too old for them to get involved.
    I think I have exhausted all avenues now.
    Any comments?

    If you read the FAQs, you will see that claims must be brought (in England and Wales) within 6 years so sadly there is nothing you can do.
