Don't bother trying to use NWNF companies if your claim is more than 5 years old as they don't want to know! Only company that does is airline recovery but they don't seem to want to take virgin to court they kept saying that the CAA is the best route but we all no they don't want to know!0

Totally agree and I didn't dismiss but to me mediation suggests meeting somewhere in between your aspirations and what is justified. Monarch offered me FA (in fairness my court [£35] costs back) so I told them to Foxtrot Oscar and ended up with double my claim
Got another one underway with another airline now so it will be interesting to see if their approach is any different.0 -
I was on this flight with friends and family and I have been told off them that they wont be paying us compensation, I was wondering if I would just be better off going down the court route instead of all the tooing and frowing
Yeah save yourself a lot of agro and issue court proceedings. It's a waiting game after that though so be prepared to be patient.0 -
We have had the same court date and are preparing our case - however we have still had no guidance of what to prepare / what is expected of us yet.
Interestingly enough we have been told that we are only 1 of 2 cases being heard on this date and that this date may change because there is potentially not enough time that day to hear the 2??!!
I'm under impression reading other posts that over 200 people are claiming for this flight, this is why it was originally to be heard in Horsham before being moved up to Durham etc... Now being told 1 of 2. Where does the 200 claimants figure come from? Do others on this flight have court dates set? Clearly the first hearing is going to set precedent somewhat so would be interested to see who is up and when!!
Hearing fees paid today, now all I can do is wait.........0 -

Just had a reply and they have dismissed it on the grounds of
15 airport closure. Closure of either the airport of departure for non-security and non meteorological reasons.
Which is part of the extraordinary circumstances criteria due to the closure of Gatwick airport's runway caused by contamination that needed to be cleared before aeroplanes could land and take off safely.
Now this isn't what we were told at the time. We were told there was a delay at the previous flight. Flights were taking off at Gatwick on that day and on our runway. We were the only flight delayed. How would I check this out ??

Thanks for letting me know Magdoc. I sent the forms for myself and my husband together a couple of weeks ago and we have had separate replies saying they will be in touch within 28 days.
As i'm absolutely no good at lette writing or putting things/thoughts on paper, if they come back with a negative response I may use someone like Botts0 -

I was on your flight VS044 on 26 July 2010 and received the same letter as you claiming failure of ECU. Have you been successful in your claim? I have been reading all the forum pages continuously for the past few months but can't seem to see anyone else who has been claiming for the same extraordinary circumstance.
I have claimed through the CAA - waiting for them to work through their backlog.0 -
Just received my response to VS85 28 April 2011 Manchester to Las Vegas where it was delayed 3 hours 59 minutes (like to check that by the way!)
It was delayed due to Number 16 which is Medical Grounds. The aircraft that was scheduled to take us to Las Vegas was diverted because a passenger became seriously ill onboard and it had to be diverted to Gander, Canada so the passenger could receive treatment.
Obviously was a shame but surely they had enough time to sort a replacement as this was the previous day? Anyway thoughts please as if you don't think this can be claimed for I will drop it now.0
