Well what good news thank you to all who contributed to this thread which I read diligently. I have not as yet received their cheque but I am sure I will but if not I will, issue a warrant.

Yes, I used MCOL after the preliminary letters and usual rejections stating 'unforseen circulstances' but I persisted. I paid my money to the MCOL and kept an eye on the proceedings, then waited 28 days for Virgin to reply which they did not so, I requested judgment via the on-line service. The judgment was issued the same day. As I still do not have the compensation in my hand, I am going to wait until the end of this month (October), and if I do not have their (Virgin atlantic's), cheque by then I will issue, a warrant against Virgin atlantic to recover the money.
All I can say to this forum is please keep at it if you are seeking compensation, if you are right you will win and a BIG thank you to all who contributed to this forum. :beer:0 -
Evening All. Well we had our hearing today and the result....Judgment for the Claimant. The flight we were claiming for was the VS16 MCO - LGW flight on the 20th May 2009 which was due to depart at 7:30pm but which took off at 00:16. The delay was caused by a crack to the flight deck windscreen on the flight coming out to MCO from LGW.
After preparing for the case and ready to fight our case I have to say that I was in some ways a little disappointed when the Judge handed the Defendant's representative the Court of Appeal case from the 15th October in the matter of HUZAR V JET2.COM. I felt for the rep as she was not aware of the case and the Judge was of the same mind that no matter what, a technical fault will not be EC.
Our case was adjourned for the representative to consider the case (which the Judge kindly handed us two copies of) and she had to concede the point.
Hopefully now knowing that technical faults are not EC will mean that so many more of you will be receiving payments. If not then in addition to Wallentin case you should definitely be quoting Ronald Huzar v JET2.COM.

Well done! Interested to see that the case was conceded (notwithstanding the difficulties of credibly arguing against the Huzar ruling rationale). I'd love to think Virgin will apply the same common sense to all outstanding cases ....0 -

I applied for compensation for myself and x3 friends who I traveled with as I was the lead member. Flight was delayed over 4-hours. I have received a cheque for £250 for myself but nothing for my friends. Should be £250 each surely? I was expecting £500 actually but won't be too greedy!
Flight was Vegas to London. Any ideas on how I get my friends compensation? I sent all their info in the first time.0 -
Finally got around to making a claim after realising the 6 years were nearly up in December and filled out the claim form and sent it to Virgin on the 17th of this month and have been waiting for the sorry its down to EC letter, but to our amazement today had 2 cheques for 511 each :j:j
Flight was Gatwick to Orlando on 29th Dec 2007.
Fingers crossed for my other flight we claimed for too.0 -
