I was on VS043 to Vegas on the 7th August last year that was delayed 23 hours. Had the standard rejection due to EC, so submitted a claim via the Small Claims Court for the 4 members of my family. Received a cheque today for £2120, as long as I drop the case! Very pleased, so thanks to everyone on here for their excellent advice.
Need to get on Monarch's case now for another delay in 2011, but have a feeling that one's gonna need even more perseverence!

At the risk of opening myself up to accusations of self-publicising, can I point you in the direction of a post I made yesterday?
It's easy to get drawn into discussions about the specifics of a technical problem. The airlines do this, I am sure, to cloud the issue and to represent the EC test as something that it isn't.

Hi all i am about to start preparing myself for a mediation call that is on the 26th. Im not quite sure what to expect.:o
Do i need to prepare myself as if i were going to court or is this less formal etc? Is it just key facts or will it be more of an argument with the mediator going back and forth?

Hello all, ref my posts Nos 1155-1158 I still have not received the cheque from VAA. the judgment was issued on 23rd October, today is 12th November should I be a little more patient or issue a warrant? I do feel they are 'messing me around' (to be polite) as I have had an email from them (VAA) to say they will pay in full and that they have one month from the judgment date. I cannot find any information as to how long would be a resonable time to wait for payment before issuing a warrant.0

what do I need to do? do I need to produce a court pack. is it upto me to proove that they were at fault or for me to proove that they weren't? i obviously need an arguement!0 -
Hi can anyone advise. I have written to virgin on separate letter about.two different.flights one in September 2006 and one in 2012. I uses.the standard compensation letter as both flights were delayed over 5 hours. They have acknowledged receipt of both letters separately but in chasing a reply I'm months on and no response. What do I do next as I purely have flight numbers and dates no other details.

We submitted 2 claims at the beginning of Oct and had a cheque within 10 days for one of the flights.
Our second claim hasn't been acknowledge at all and I send a second letter to them over a week ago but still nothing.

My family and I flew back from Florida last year and encountered a 26 hour delay due to a technical fault however the aircraft had been in for maintenance just day before. We applied for compensation from Virgin Atlantic but they said that due to extraordinary circumstances they would not pay up. At the time I took a large number of emails from other passengers and set up a facebook page and we are now in the process of writing to VA formally through a solicitor. They will have 28 days in which to respond or it will be taken to court. There are about 70-80 of us in the group. I have to say though the only reason we are claiming is that we were treated like dirt and not looked after at all. Maybe they need to sort out their customer service for when things go wrong. I'll keep you posted.0

Hi, I along with the wife and 2 kids were subject to a 27 hr delay on a virgin flight from Orlando to Gatwick (same flight as Psailia on here I believe).
I have filed my MCOL and just had back my request to complete a Direction Questionnaire.
I have a question that I hope someone can help me with:
As I filled out the MCOL in my name and for my wife and children they are saying ''As a preliminary issue, the Claimant purports to bring this claim on behalf of 3 other persons. the claimant has no standing to bring a representative action.''
I think I read about having to fill out the forms in paper format rather than online, but I'm already down the road, any suggestions please?0
