Hi any luck today with the mediation I had my letter back from court virgin going to defend the claim
Been waiting for the cheque before posting.....
Have received cheque for full compensation & court fee in the post after mediation.:rotfl:
Mediator was great, couple of phones calls, slight arguing one point of defence, and that was it.

Today I have received a date for mediation 26th November. For 27 hr delay mco to lgw 22nd June 2013. Fingers crossed!
Seems to be a fair amount of success at mediation lately.0 -
Just had a look on this site - looked into the archives for VS74 (June 7th '13) and it claimed the return flight VS1074 (8/6/13), returned after "technical issues".............what is that about. We had a sick pilot, who do we believe???? Where did the people running this site get their information?
After reading mind numbing amounts of information on the net, if it has been classed as a "technical issue" and not personnel sickness/illness then why am I prepping myself for a day in court.

The issue is whether the delay/cancellation was a result of "extraordinary circumstances". Neither a technical issue nor staff illness is likely to be regarded as such by a properly informed judge.
Remember also that even if the airline succeeds in proving "extraordinary circumstances", they still have to demonstrate that they did all they reasonably could to prevent a delay/cancellation from occuring as a result.
As you have time on your side, you could seek clarification from Virgin but I don't think they are on top of their inbox at the moment so you might prefer to proceed with the legal claim and see what defence they actually come up with in response.0 -

I'm still waiting to hear - how long after you sent your directions questionnaire back did it take for you to hear about mediation?
I'm in 2 minds - especially after the Muzar case. On the one hand, I'm not that keen on a court hearing, on the other hand, I feel anything less than the full amount of compensation is giving up to easily!

Personally, I can't wait to get into court and show Virgin that a pilot illness can never be considered EC. Statistics on staff illness back this up and Orlando is clearly an important base where they should have contingencies in place - any reasonable judge must agree so bring it on!0 -

I put in separate claims for myself and my partner, sent in separate envelopes at the same time/day/post office. Partner received a letter 10 days ago saying they're looking into it - I've received nothing.
Does this mean anything?0
