The defence Virgin sent me said that the Pilot was taken ill 2hours before boarding! Are they getting confused?
Also, the list they refer to is not law it is guidance! The law is Wallentin/Sturgeon.
Virgin have claimed in the defence that I received that he took ill two hours before the flight but as this was one hour before pre flight checks were due they class it as being on board!! The cabin crew when we eventually flew home quite openly told us the Captain looked ill all day and eventually saw a Doctor a few hours before the flight but they already knew they would not be flying that night. I know he wasn't seriously ill (thankfully) and flew home as a passenger on 9th June. The main line they keep using in any correspondence I have received is they could not be expected to have a standby pilot at a airport abroad. Orlando at that particular time of year is one of their busiest airports, surely they should have a back up plan. Especially as a pilot went sick on this route just one week later and they paid compensation for both Gatwick to Orlando and Orlando to Gatwick flights.:(0 -
I think they fly there twice a day 7 days a week. Miami too. So of course a back up plan of stand by crew at such a busy airport for them would be considered 'reasonable'.
It's not exactly using all their resources up to an 'intolerable' level, is it.

It seems like VAA are struggling to find a viable defence in my opinion. The captain was ill, the crew knew they wouldn't be flying that evening and VAA did not "deploy all of it's assets" etc, etc. It also seems they want to brass it out as my court date is looming and I will shortly be paying my fees and entering my case as stipulated in the order I received a few weeks ago. Mediation out of the window!!
If however VAA decide to fold and pay up with the usual gagging order - I will not be best pleased after taking so much time and effort to prepare, only to be cast aside like an annoying itch. We are after all paying customers and expect a level of service parallel to the amounts of money we pay. I expect to be compensated when I don't get what I paid for. Nowhere in my holiday documents did it say " in the event of personnel sickness we will not be able to get you home on time" but alas it seems VAA have decided not to have a standby crew in one of their busiest destinations because "it would cost them too much to do so........." It must be a business mans logic because I don't understand it. Rant over.......0 -
Looking to connect with people who were on the 22nd June 2013 VSO15 flight.
I read earlier in this thread that someone on this flight was informed of the delay 10 hours before take off - I didn't receive such correspondence.

I too was on flight VS015 from Gatwick to Orlando and we only found out just as we were waiting to board. I think the people waiting to fly back to Gatwick from Orlando were given 10 hours notice.0 -

It sure was a nightmare, especially when they herded all of us down to customer service! It was my first time flying with Virgin and we only booked 9 days in Orlando so we lost a full day and bit
I have only sent my NBA last Wednesday. I did write to the CAA in August but they sent it back to Virgin and they never got back to me.
It doesn't surprise me they are still claiming extraordinary circumstances!, keep me updated on how you get on, hopefully we will win this one0 -
hi, I was just wondering if anyone had had any luck with claiming compensation for the 25hr delay on this flight, I have had my (!!!!!! off we are not giving you a penny) letter back then I sent paperwork to CAA, they sent it back and told me to apply online, which I did, then they wrote and told me to send the paperwork back, but as yet ive not heard anything, imjust wondering wether to cut to the chase and take them to small claims court or get a NWNF LAWYER ON THE JOB INSTEAD OF ALL THE MESSING ABOUT, can anyone advise please and thankyou0
