    Is this the template that I need to send?

    If so, I have already asked for compensation over the telephone and they have refused stating 'Extra Ordinary' circumstances as I listed in my previous post.

    If this is not the template please can you guide me to where it is as I cannot seem to find it anywhere. Thanks.

    I am writing to you in connection with the above flight which I was booked onto on [date].
    [Either]:
    The flight was supposed to depart from [departure airport] at [time], but was cancelled.
    Under EU Denied Boarding Regulation 261/2004, I opted to take the re-routing option.
    I am entitled to the sum of € [see table on the flight cancellations page] compensation and look forward to receiving the sterling equivalent within the next 14 days.
    I attach a copy of the ticket.
    [Or]:
    The flight was supposed to depart from [departure airport] at [time], but was delayed by over [number] hours.
    Under the EU Denied Boarding Regulation 261/2004, I am entitled to the sum of € [see ] compensation and look forward to receiving the sterling equivalent within the next 14 days.

    Also, Given all the details of my case, do you think Easyjet are correct to state that it comes under 'Extra Ordinary' circumstances?

    Looks close enough but strange that the delay section refers to departure times rather than arrival times which is what matters for the purposes of the Regulations.

    As you have already been refused, I think you can reasonably tag on the relevant wording to the effect that if you don't receive the compensation due by the end of the 14 days, you reserve the right to take legal action without further notice.

    You really need to read some of the material on here so that you understand the basic law you are dealing with. The answers are pretty well all in the FAQs. You are potentially only 2 weeks away from making a claim and you need to understand the basis of your claim by then. The Huzar case is a very good (and accessible to the layperson like me) summary of the relevant law - read that thread also.
  • @ David - I have read through the things on page 1 and what comes under extra ordinary circumstances. My understanding, correct me if I am wrong, that extra ordinary circumstances is only when a delay is caused which is out of the airlines hands.

    They tried to tell me that because the plane expected to arrive at Prague to take us to Bristol was diverted this comes under extra ordinary circumstances. In your opinion would you agree with Easyjet?

    Absolutely not because it's the same nonsense that pretty well all the airlines use and which we are all fighting against. If you read the law, there is nothing whatsoever that supports EJ's position.

    Thank you for your reply. So I will now await the email from them stating their refusal for compensation along with their reasoning and then I will send the NBA letter. Do you think they will give in once the NBA letter is received?

    Almost certainly not. They will make you work for it so you need to be prepared to follow up the "threat". You can do it yourself (using the resources on here for guidance) or instruct a no win no fee lawyer.
  • After only 6 weeks I received my €400 per person compensation from Easyjet for the above delayed flight. I couldn't have done this without MSE, thanks Martin!

    I think you can do either. I sent a hard copy as I thought it was easier to evidence that it had been sent (and received if you pay extra for that). I think evidence of sending is actually adequate on its own.
