My contention is that the preamble, in section 14 also states "....operation of the flight concerned"

My interpretation and understanding of this wording is that, in principal, an ‘extraordinary circumstance’ can only take place on a particular flight on a particular day. So by it’s very definition, this cannot also include a following or subsequent flight, in other words, knock ons.
Only the original problem on the original flight can be classified as extraordinary.
So in your daughters case, whatever the problem was with the previous flight it has no effect on her flight and should not be taken into consideration.
The ultimate reason for your daughters flight being cancelled was because the crew ran out of hours and EJ did not supply a standby crew. EJ then made a management decision to supply standby crews to other flights but not your daughters. It was, therefore, EJ management who made a conscious decision to cancel that particular flight.
From what EJ say, her flight was only delayed by up to 1h 14m, which would not qualify for delay compensation, and so, in isolation, that was not the ultimate reason the crew ran out of hours.
Compensation due IMHO.

For what it is worth, I agree with Tyzap. But you need to find a way to make this point easy to understand to a judge. Your post is quite confusing - as no doubt the airline meant it to be.0

Another easyjet plane arrived to take us to GATWICK then a coach transfer to Manchester.
I didn't make a note of the actual times of delay. Today I received notification via Resolver that easyjet say the delay was less than 3 hours. I'm pretty sure it was more than 3 hours.
I don't know the flight number of the rescue flight to check actual arrival time in the UK.

there were 2 U21966 flights that day
BIA-MAN scheduled departure 11:20 scheduled arrival 12:50
BIA-LGW scheduled departure 13:50 scheduled arrival 15:10
I assume the second was the replacement flight which did indeed land back in UK under 3 hour delay...however it landed in LGW...I expect the coach would have taken longer than 40 mins to get from LGW-MAN so you would have been back in MAN more than 3 hours late
Read Vauban's guide and maybe remind Resolver than you were flown back to a different airport0 -
And if the coach did indeed get back to Manchester Airport in less than 40 minutes report it for Speeding. LOL0

something very strange is going on- i know for a fact that an easyjet flight i took in 2012 was delayed over 3 hours - yet easyjet are saying it had a 38 minute delay -then i checked with flightaware and its saying something different- flight stats want me to pay $167 to get their feed on this flight - how can i double check any free site to prove to easyjet that i am entitled to compensation since the new appeal process last week suggested i am entitled to compensation- i was not alone on this flight - an acquaintance of mine was also on it and stated the same as me. was anyone else on flight ezy 2410 from malaga to luton on 4/5/2012 that did not in fact take off until 3-4 hours later? and arrived back in luton hours after the scheduled time0

Registration on flightstats is free. If you are convinced delay was over 3 hours then submit claim and if rejected follow Vauban's Guide and take EJ to court either under your own steam or via a NWNF.
