    Take a megaphone (or some preprinted A4 flyers) with you next time. :)
    I always have a memory stick with Vauban's guide and several other pdfs loaded, in case anybody wants the info ;)

    Absolutely, I realise that I got a ‘cheap’ flight initially and IF they had looked after us, I would have been happy with that, but they tried very hard to issue refunds, to negate their ‘right to care’. I just wanted to be treated fairly and reasonably.

    I’m very lucky I have quite a high credit card limit so the extra £1,000 in costs went straight on that, but not everyone could have done that.

    My other half lost three days pay, so the compo helps replace some of that. I wonder if they would have paid up if I’d been an LiP ?



    I still think they should have paid up on the first cancellation, they should have operated the flight with an alternate aircraft and bussed us to Leeds. But I’ll have to accept Cobys advice on that one. The fact that they paid out on one AFTER court proceedings issued, shows that they did not have a valid reason for cancelling that flight. They were cancel happy for those few days!

    So yes it cost them more with me in the end, but AFAIK I’m the only one to go through Botts for those flights, so they saved overall.

    Finally, I gather that the Court of Appeal gave permission to appeal in Blanche but I don't know what happened or is happening.

    You are quite correct about Blanche, I don't know anything about the case but I do believe the case is due to be heard early next year in the CoA.

    It is an important case though, because as in my case Botts are reluctant to take on cases where ATC restrictions on the previous leg of the flight have caused a knock on effect delay, mainly I suspect because they are unlikely to convince a judge that it's not a genuine EC.

    It would be very interesting to read about the Blanche case, if anybody has a link to the judgment where I can read about it please post so I can have a read through.

    I'm not at all sure whether the question is as simple as:

    Is an ATC restriction a genuine EC ?

    Or if it involves knock on ATC restriction delays so then the question may be.

    Is a flight that is delayed by a genuine EC (ATC) on the previous leg of an earlier flight still to be regarded as one and therefore it's subsequent delay is also regarded as an EC ?

    My own view I've already stated but I'm going to add it to the Thomas Cook thread shortly, b100dy knock on delays!

    For those of you that remember, I'm in the process of claiming against Jet2 for a delayed flight from Thessaloniki to Manchester last June. I've avoided posting publicly for obvious reasons. Tyzap and NoviceAngel are up to speed and have been so helpful.

    My hearing date is set for 15th June in Leeds and my case is, I believe, being heard with others relating to the same flight. I'm in the process of beginning to construct my witness statement and am using Vauban's superb guide, but I must say I feel quite overwhelmed!

    Unfortunately not. That said, my case was moved to Leeds from Sheffield, which I believe was to allow it to be heard alongside others. I won’t be ‘alone’. That said, nerve wracking nonetheless.
