Hi,
Bott and Co will sort J2 out again, they have a very good record against them.
Particularly when J2 Insist on fighting lost causes which they obviously cannot win.
Just hope the CAA are noting that they are up to their old tricks again.

Just wanted to provide an update on my case as detailed above. Jet 2 are still denying responsibility. I passed the matter over to Bott Online and the case is now being taken to Liverpool County Court.
Fingers crossed, I will let you know the outcome.
Thanks for coming back to us Charlene, I looked back and read through the thread from Feb. Have they formally put in a defence stating ATC restrictions caused the delay?
If they have it should be an easy case for bott to win or lose depending what evidence they produce. The only thing that would be tricky (which they may be relying on) is that if the door caused the delay but there were also ATC restrictions at the same time, but Bott will be asking for the aircraft maintenance records, they obviously will show the real cause of the delay.

Yes I believe Jet2 are still saying that the delay was due to ATC restrictions.
I think that's what they relying on that the door did cause part of the delay but there may also have been other issues.
I'm hoping that along with our evidence and the investigations from the CAA we have good case.
Bott & co have advised that they have received a number of claims from the same flight which is why they are using our case as a test case so hopefully we all receive the compensation we deserve.

After much arguing between jet 2 and myself I have gone with Bott and co to take it forward.. I believe my delay was a knock on effect from my plane having to land at a different airport the day before my flight from Malaga due to fog.. It landed in Man instead of LBA which affected flights the day after.. Have emailed all my documents so it's fingers crossed time:-)

Update - Bott & Co contacted me on Friday to say that they have now received the correspondence from Jet 2 which was submitted to the court and they can no longer act on a no win no fee basis as they believe that the court will rule in favour of the airline.
Feel like it's been a total waste of time.
Our options were to continue with the court proceedings however we would have to pay Bott & Co to do this and to be honest it wouldn't be worth it as the compensation we would receive would be less than the legal fees.
Hopefully others have more luck with their claims.0 -

Disappointing news, indeed.
So it looks like there were ATC restrictions that caused a significant delay, and it would be hard to prove what portion of the delay was caused by the door problem.
You win some and you lose some, I recently lost a court case (not flight delay) but that cost me court fees and an awful lot of time and effort, at the end of it all at least you didn't just roll over and you fought back, that should give you some comfort if not financial redress.

I didn't have much time to reply this morning but felt I needed to say in addition that it wasn't a waste of time.....
1.. anybody else on the same flight will now know any claim is unlikely to be successful
2.. you made a stand and refused to accept the usual dross of J2 so you do win ( if nothing else they paid the birds to defend your claim and obviously others on the same flight )
I recall some posts earlier on this thread that would mean my case against them was a none starter, I gave it a go and that's all you can do if you have been sleeping overnight at a closed airport, then go the same route either follow Vaubans guide or if you have to, go NWNF but please don't just give up, and you didn't, so like I say well done and if any delay comes your way again, you'll have the flight delay rules at your fingertips.

Trying to read between the line, it may well be that the door problem pushed the delay up to, say 2h45m. But not a claimable delay. At this point the aircraft had now missed it's take off slot with ATC, causing a further delay.
If the new slot's departure time then further delayed the aircraft causing it to become claimable, Jet2 may be able to argue it was this which triggered the delay, not the original fault. In this case it may not be worth Botts or yourself risking what a court may decide.
Conversely, you could argue to the court that had the earlier technical delay not occurred in the first place then a short ACT delay would not have caused a claimable delay.
