    Hi,


    Just an update on my case. I issued my NBA letter to Jet2 who again refused the compensation. I then contacted Bott online and agreed for them to take on my case on a no win no fee basis. This was a few weeks ago and I signed all the paperwork etc however today they have e-mailed me to inform me that they will not be taking my case any further as they can not guarantee that they will be successful.


    So basically Jet 2 are refusing, the CAA have said that they should be paying compensation but can't enforce it and now the no win, no fee lawyers can't guarantee we would be successful. Looks like Jet 2 are getting away with it. Total joke!

    Charlene - post relevant details and read Vauban's Guide. Bott & Co have been known to make a mistake when analysing chance of success.
    Unusual for the CAA to 'take your side' as they tend to agree with the airline where there is any doubt.

    They said that they feel it is unlikely that they would be successful in recovering compensation for us on this occasion. No other reason was given.


    Going to try another no win no fee company I think but not sure if we will end up with same outcome.

    That's what I thought so we were quite hopeful of receiving the compensation via the no win no fee company.

    I received £175.88 from Ryanair for a flight, from Glasgow(Prestwick) to Carcassonne flight No FR4451 which was delayed on 26th April 2012. Thanks to the resolver tool, although it did take two attempts which was to be expected.

    I tried several time on my own to get a satisfactory outcome to the issue without success.

    therefore many thanks for offering advice and templates in which to use to pursue my compensation claim.

    So there has been a change of heart at Bott online, I received a further two e-mails last night informing me that they are now issuing court proceedings with Jet2 on my behalf and another e-mail stating that they are using my case as an informal test case and taking them to court. I have e-mailed bott online to clarify as I'm not sure why I received the first e-mail saying they weren't taking it further, so hopefully fingers crossed we get our compensation.


    I will keep you all posted on the progress.

    It must be a marginal case that could maybe go either way so they are testing it. It would be interesting to know what the issue is.

    Maybe they got the door fixed but were held up by air traffic control for an available slot. So they might be trying to argue ATC decision.

    I think that's what it might be, they said in the e-mail that the technical fault of the sensor on the door caused the original delay which then could have caused the air traffic control issue so they are going to fight that it was the technical fault which actually caused the delay. Fingers crossed that we get the outcome that we're hoping for. They also said that they have received a number of claims from passengers on the same flight so hopefully Jet2 start paying up.
  • It sounds like having a few other claims from the same flight makes it worth while for Botts to go to court. It's probably best that you didn't try to fight it yourself. - good luck
