Sent a template letter to Jet2 regarding my 6 hour 30 mins delay back in 2012 I have found my boarding passes, booking reference and even the letter they gave us in larnaca airport stating that they have to fly another plane out due to a "Technical Fault" on the plane which we were due to travel back on.
After 3 weeks I have received a letter off Jet2 stating "the aircraft due to operate your flight was unable to do so as scheduled due to a hidden manufacturing defect" there for no compensation due to extraordinary circumstance.
As the bulleting I have received and have still got from 2012 in Cyprus states a "Technical Fault" I think they are trying to fob me off so I'm now going to contact botts and see what they say.0 -
Read Vaubans guide would seem a valid claim on the face of it. Post you flight details and someone will take a look.0

The flight was LS466 from larnaca to leeds bradford departing on 19th September 20120

Bott & Co's flight delay checker say you are due 400 euros per passenger. As above read Vaubans guide and send them a Letter before Action. If they don't reply or say you are not due compensation you can either issue court proceedings or pass it on to a NWNF solicitor.0

It is Jet2's usual pathetic, and disingenuous, attempts to dissuade you from going further with your claim.
Time to issue an NBA then probably an N1 form to your local county court. Or hand over to Botts.

Just thought I'd give a final update on our Jet2 compensation.
EUClaim have told us to cash the cheques and have forwarded us an invoice for their standard NWNF charge of 27% of compensation amount + €25 per person. No additional charges for claim form being sent to court etc.
Losing a chunk of the compensation but as far as we're concerned it was money for nothing anyway.0 -

to add a brief gloss to JP's observation, a "hidden manufacturing defect" has indeed been previously allowed as an "unforeseen circumstance" and therefore not subject to compensation However, an airline finding such a defect is of course obliged to contact the manufacturer which is then also obliged to arrange to check all the affected aircraft. There would of course be a paper trail to confirm all this. Both JP and myself would be most surprised to find Jet2 able to produce this. If they do fair enough but we suspect your quest will be successful.0

Yes, it's almost certainly a bluff. There has to be documentation to confirm the defect existed, either issued by the manufacturer, or from the airline in the form of a Mandatory Occurrence Report to the CAA. Without this proof it's just a plain old technical fault. I fought a hidden manufacturing defect on this point and it turned out not to be so under scrutiny. Unfortunately you will only flush out the truth by starting court proceedings or instructing a NWNF.0 -
Some encouragement for others... I had a claim against Jet2 for a delayed flight. Wrote to them a number of times and received rejections. Waited until the outcome of the most recent ECJ appeal before deciding whether to proceed. Have just written to them again and received a cheque in the post in reply for the full amount.0
