    They are only stating how all EU countries apply the rules. It is the NEB in the state of the departing flight that is responsible for investigating any written complaint from passengers so you shouldn't be shooting the messenger.....
    Fair point. At the end of the day it is still Jet2 who have to prove extraordinary circumstances. Since they won't produce any evidence to me they will simply have to produce it for the judge. Given their persistent refusals, I have asked for interest and (tongue in cheek) costs.

    Got a reply to my letter today requesting specific information on the unexpected flight safety shortcoming,in which I said I would start court proceedings if I didnt get a detailed answer.
    Jet2 continue to say the tehical fault could not have been forseen and all reasonable measures have been taken,but still giving absolutely ne detail to allow me to make a reasoned judgement.
    I dont think I have any choice but to start the court proceedings,so any advice appreciated as am not familiar with the process and am nervous about risks of getting costs awarded ?
    Any thoughts advice appreciated....

    I had received the usual EC excuse namely a flight safety shortcoming without explanation of the fault so i sent a NBA requesting full details of the reason for delay within 14 days or i would commence legal proceedings.

    I got a letter back saying they were sorry that the matter could not be resolved and they would review all correspondence.

    So the question is do i wait for their next letter? Do i send another letter giving them 14 days to review correspondence and providing a detailed response or do i just start legal proceedings.

    We seem to be in the same situation. They told us it was a cabin pressure fault. We sent a recorded letter giving them 14 days to give us more info. It is now over the 2 weeks and I am not waiting any longer.

    My question is, how is everyone else getting on. Who is furthest down the line?

    Does it make a difference doing it online (MCOL) or by post?
    Loved our trip to the West Coast USA. Death Valley is the place to go!

    I don't think i've seen a post yet where jet2 have changed their minds after a first letter denial and offered the correct compensation, so filing a court claim without further ado is the next step IMO.
