And they wont give you full details of tech/EC until you do. Which goes against them in court.

Am I right in thinking that a return flight that is delayed because the inbound flight was the one with the tech problem, cannot be used as a flight delay because of EC?

Could someone advise me rightly or wrongly please?

sharalee - generally yes, especially if previous dely was a tech. Jet2 seem to be ignoring this basic tennant (sp?) of the EU regs.

Thanks. that's what I thought. I will try and search for that particular bit and try that in 1 more letter. I can't do MCOL as I live in Scotland, so it would be the Sheriff Court next.
My fear is, like others have said previously, not winning in court then being left to pay all the costs.
What also gets my pip, is my son got £714 today from TC after writing 2 blooming letters  (Just a bit jealous lol)

A few of questions regarding MCOL claim.

    1. The date the money became owed. Is that the day of the ruling or the date of the flight?

    2. What is the daily rate of interest.

    3. Should the claim amount be converted to sterling using the exchange rate at the day of the claim.

A few questions similar to Northwests...

    Hi All,

Just received my second letter of rejection from good old Jet 2. They have given me a reason for the technical fault, a hydraulic leak. Can’t do a lot with that over simplistic explanation, so...

Hi Ho.... off to court we go !

Got a few questions with regards the forms and its details and I wonder if you kind people could help me ?

I believe it is the N001 form that I have to fill in (there are multiple claimants) Me, The War Department (wife) and three Kids.

    Brief details of claim.

    What would I write ?

Compensation claim(s) for delayed flight under EU Regulation 261 (2004)"

    O.K ?

    Value

The amount I am claiming is for 2000 Euro (Manchester to Malaga), this is the amount, I have been requesting in all correspondence with Jet 2 in the 2 letters I have sent so far.

What about interest, should I be claiming for that as well ? (The flight was in August 2009 – 4 years of interest !) Would I be able to add this on at this stage ?

Should I be claiming for the cost of sending them to court as well ? I.e. the Courts fee’s, would I put that in the final total or would the court add this onto my final “winnings”

On the form, would I put the amount in Euro’s or pounds sterling – If pounds, what conversion rate would I use ?

    Particulars of Claim (attached)(to follow

What level of detail would you include in this box ?

Would you just include details such as names, dates, flight numbers, flight details (i.e. Malaga – Manchester) length of delay etc ?

Or would you also include precedent EU Case details as well ?

How are you guys getting on with each of your own particular Small Claims Cases ?

    John

    1. The day of the flight
    2. 8% annual simple interest, so times x 8% then divide by 365 then x number of days since flight
    3. exchange rate at time of flight. (better for most over past 2-5 years)

You are limited by number of characters/lines on MCOL. You can be very detailed if you do a paper submission to your local CC.
There is a question over multiple claimants on one claim form. Jet2 using this a a defence tactic (?) in my case. I have asked court for pre hearing direction on this.
Other than get all the info in the you can including the relevent EU ruling(s), dates, delay times etc and the amount inc interest.
I think most are awaiting hearing dates, but not holding breath.
