    Latin is frowned upon in the courts these days although we still talk of "ex parte" i.e. without notice applications.

    One from the past is "In Loco Parentis" which means "My father's an engine driver"

    Jet2 use this when you use MCOL and put the particulars of another claimant in the details of the claim.

    They say you have no authority to claim for more than one person, that's why the advice now is to use the form N1 and not MCOL for more than one claimant.

    I'm going to ask the DJ if he/she would accept an oral application at the start of proceedings to add the other claimant to the claim.

  • 2bs have to reply to court before 25th March with directions
  • If I was you Angel I would bite the bullet and include added claimant on N1 before proceedings start as it would be cheaper and less hassle than having to start another claim if the judge denies your request. I have also done this and will ask my judge if this was actually an unnecessary cost enforced by the 2bs insistance on individual names as claimants despite being on the same booking and if so claim it back on costs.

  • Sorry Angel the form N244 is the form you require to make an alteration to the details on the N1 form.

    I sent mine to the County Court along with a fee of £55 if my memory serves me right.

    I believe that you need to send three copies but there is all the relevant guidance available if you just type in N244 form and google it.

    You add the additional changes in red ink and give reason for doing so. On my form I stated that it was a direction in the defence solicitors notes.

    I don't have the knowledge to state categorically that this is a must but it is the only way I know for certain to add extra claimants because this request on the N244 form goes before the judge and a decision is made and notification logged.

    From what I've read you're quite correct, but I'll hold off doing it for a while and get some more opinions, I recall reading a post from someone, I think with legal background simply stated that an oral application at the start of the hearing is all that is required...

    I'll look for the post and come back with a link if I can find it.
