    Just wanted to get an idea of how long it has taken some of you to get a reply to your initial letter? I sent my initial letter on 28th Dec 2012 via email. I got the immediate reply saying they'll aim to respond within 28 days. I didn't get anything within 28 days so i emailed them again at the start of Feb asking for confirmation that my initial email was being investigated. Again i got the immediate response saying they'd aim to reply within 28 days, but i've still heard nothing.

    From reading through this forum, it sounds like many are getting replies, if only to state "extraordinary circumstances".

    Has anyone else experienced such a delay to their initial letter/email?

    Hi, I didn't have a reply to my email requesting delay time and reason other than the automatic response one. I have had replies to the ones submitted by post although they appear to be standard delaying letters... You can read my history so far further up in this thread.

    Maybe write to them?

    Have decided to submit another letter before the nba one asking them to clarify what information is missing. I also want to put in something about the booking ref/screen shot of booking being acceptable confirmation. Does anyone know if this is written down in guidance anywhere or stated as such by the CAA, that type of thing?

    My father is also going through the process as same flight, different booking ref. He is thinking of going along the no win/no fee route. Does anyone have any thoughts on this?

  • We received a reply today. Originally got the "flight safety shortcoming" letter. This arrived today

    I have noted your comments that you believe technical faults cannot constitute an ex circumstance under EU Reg 261 and your ref to case Wallentin v Alitalia. If I may clarify that the regulation does not define ex circumstances. However technical faults can, depending on the individual facts surrounding the delay, constitute ex circumstances. The Wallentin decision to which you refer to confirms this. Having completed a thorough investigation I can confirm your flight was delayed by a cabin pressure issue. All reasonable measures were taken and therefore it was an
    extraordinary circumstance. No compensation is payable.

    Thoughts please anyone?
    Loved our trip to the West Coast USA. Death Valley is the place to go!

    write back and ask for exact details. This general blanket statement from Jet2 is usual but you need detail to decide to pursue in court or not.

    Certainly more detail required as to what sort of cabin pressure issue it was.
    The detail in the ruling is that a tech issue, on it's own, is not enough to be an EC. It needs to have stemmed from an EC that was beyond the airlines control. So, did the weather cause it? or a terrorist attack? etc etc
    Complying with minimum servicing does not provide an EC to an unexpected tech issue either.

    It will do no harm but dont expect a response anytime soon.
    I wrote to CAA 4th Jan, no response or acknowledgement to date.
