Apologies for not too many posts from me recently, I've been preparing for a little bit of upcoming business.
Which was on Friday just gone- and a day in court for me....
Why?
Well helping a good friend and colleague of mine as a Mckenzie friend with her claim against RA for compensation for flight FR699 from Birmingham to Dublin on the 24/10/2014.
This claim had taken the usual route as per any ESCP claim but, the DJ wanted both parties to attend a hearing to discuss the alleged extraordinary circumstance- that old chesnut 'Birdstrike'.
But where were you Ryanair? I was so looking forward to meeting your representatives, and so was the judge too with 3 hours set for the hearing.
Now he was less than pleased at your no show, I lost count the amount of times this was mentioned.
Anyway onto proceedings which were fairly swift and, with a skeleton argument presented using alternative pleading -RA's defence was quickly torn to shreds.
All done in 45 minutes.

Now, where did I put the names and numbers of the other hen party members that were travelling with you..?Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

In the meantime the preliminary hearing in KLM V VDL should be known later this month....this could put it all to bed....
So if you haven't seen it already:-

And if your case is on hold/stayed because of the attributed Barnes/Allen case appeal, now is the time to contact your court to get your stay lifted.
Judgment has been made in the main KLM V VDL case that this refers to and- it's another bad day for the airlines and Ryanair who were the only airline to appeal the Barnes/Allen judgment.

After the ECJ news I wrote again to RA to ask them to answer me now and received the weirdest reply... that they were waiting for the decision in vdLans and couldn't reply until then. Anyway, it spurred me into action and finally filled in my ESCP form A. My question is how I go about submitting them to my chosen county court? In person? over email? by post? I can't see the answer in either guide, and the courts' website doesn't seem to hold any clues either! Thanks guys0 -
Given that Van dear Lans has been comprehensively lost by KLM, why not write to Ryanair one last time telling them to pay up or you will start an ESCP claim?
And Ryanair (yes, you reading this forum) stop being a prat now and obey British and European law please. Can't be that difficult, surely?0 -

If you proceed with your ESCP claim, check first with your chosen court that they are familiar with ESCP (many still are not). You need 3 copies of your Form A and, any supporting evidence you submit. Your court may be able to accept this via e mail, if not good old paper copies sent by post or in person, along with your court fee.
But....like our Lord prof Vauban says, give them another try now that judgment has been made in KLM V VDL.

Newbie here on the forums, just wanted to share my experience.
Ryanair London - Marseille flight delayed in August by 4 hours due to a technical fault. I submitted a claim using the MSE / Resolver online tool and I received a reply within a day and a half stating I will be paid the €250 compensation plus reimbursement for refreshment expenses. Result! I had fully been expecting a long drawn out fight with Ryanair so I couldn't believe how quick and easy it was. Very grateful for the MSE guidance and online tool.
Hope this might reassure some people that it is worth putting in a claim!0
