PURPLEPICKLE,
Do you mean claim compensation for the delay to your flight?
If so you are in the right place, go to my post #569 for detail how to do this.
A good read of Vaubans guide will also help you get to grips with what you need to know regarding the regulation itself and the case law that surrounds this.

Hi,
Just received a letter from the court about the oral hearing. They said that if I want to I don't have to attend and they will proceed with my written evidence, however RA can still attend if they want to. Not sure what is the best way? Obviously I am not a lawyer and don't feel too confident going to an oral hearing, however I could try to prepare for it. How about getting no win no fee lawyer, or is it too late for that?
I just have a question, in case I lose will I have to pay to RA's lawyers expenses? thanks0 -

Medis111,
So a part result in that you don't have to attend an oral hearing as you requested originally but, i'd check with your court to see how they actually are going to hold the hearing. Of course anybody can not turn up for an oral hearing (often the case with the airlines) it just seems that an oral hearing is still going to be held.
Now personally i'd be going but that is of course up to you, and the court have given you the option to not attend and just to use your written evidence.
At this stage I feel a NWNF company wouldn't represent you as you are already quite some way down a process that up to now you have navigated yourself.
If RA are claiming any expenses from defending this claim then this should have been made clear to you in correspondence from your court- although even if they win it is up to the judge as to whether or not these get awarded.
PM coming your way later with something you will find useful.

Update
Just a quick note to let you know how my case is proceeding:
Case was set for an Oral Directions Hearing next month due to me opposing a Stay. Due to the Liverpool cases I applied to the court to have this set aside and have just received letter back from court.
Upon reviewing the court file and of the courts own initiative: (courts own initiative!!! No I bloody requested it!)
Hearing has been vacated
The Stay to be lifted (although a Stay was never actually granted)
To be listed for consideration under ESCP on paper only with no parties to attend. First available date. Time estimate 1 hour. (I like this bit as i banged on about how this was originally initiated as a ESCP written claim and asked for it to be put back on track as this)
Both parties given 7 days to object or else case will be listed (will have to wait and see if Ryanair object)
Thanks for the advice Dr W0 -
Sounds like you are back on track, JJ_K! Good luck!0

In this case, the ESCP is like the Small Claims Court, it would be highly unusual for a Judge to order costs from the losing party, each party is responsible for their own costs, the only exception is if one party has acted wholly unreasonably, and to simply lose your case is not unreasonable, it is often threatened by the airlines that they will claim costs, in reality, I've never read one single case on here where the DJ has awarded legal costs to the successful Claimant or Defendant.

Hi, we’ve had to remove part of your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
If the ESCP does not award costs why should it pay to take the airline to court on short haul flights? €250 = £180 take off court and enforcements costs one is left with nothing.0
