    You have to remember that it is just business to these guys, they do what they are instructed and paid to do, by whoever instructs them.

    The reality of the situation is that they are professionals, they do their job very well.

    I have to give some grudging respect for that.

    Five airlines have been told they cannot postpone giving compensation payments to customers whose flights have been delayed by technical problems. The airlines - Jet2, Thomas Cook, Ryanair, FlyBe, and WizzAir - had wanted Liverpool County Court to stay, or delay, one woman's claim after a delayed Jet2 flight, while a Dutch case on the same issue was heard in the European Court of Justice. But the Judge rejected this saying: "Justice delayed is justice denied."

    So, if your ESCP claim against Ryanair is currently stayed in the court system pending the outcome of yesterdays hearing, write to your court with something like this to have your stay set aside and for your claim to now follow the ESCP as normal.
    Don't forget to include a copy of the ruling as has been posted over on the Liverpool Allen Case thread.

    REQUEST TO SET ASIDE STAY ORDER






    I am writing to the court to respectfully request that the stay order currently imposed on my case to be set aside. My reasons for this are detailed below.



    1. The defendant asked for a stay to be imposed onto my claim pending the outcome of case AOOBL834 that was heard at Liverpool Court on the 25/02/2015 which was attributed to the preliminary hearing of case (C257/14) C. Van Der Lans Vs KLM.


    2. On the 26/02/2015 District Judge Jenkinson made ruling on the combined cases of Allen Vs Jet2, Barnes Vs Ryanair (AOOBL834), LazareVs Jet2 and Dombovich Vs Wizzair.

    3. In each of the cases above District Judge Jenkinson dismissed the stay applications pending the outcome of the Van Der Lans Vs KLM case.

    4. Subsequent to this ruling, and the set aside of the stay imposed that I am requesting, I respectfully ask that the court revert my claim back to a standard consumer claim using the ESCP. Further to this, should the defendant be such minded to contest my case, upon receipt of the defendants ‘Answer’ to court, I, the litigant in person, shall be able to furnish the court with a response to such an ‘Answer’ as per the standard route for an ESCP claim.


    5. It is respectfully submitted that from these submissions to court, the learned judge will be able to make a decision on the instant case using the written procedure as per the guidance on the EU portal for ESCP Claims.


    I believe the facts given in the submission above to be true and accurate.
