Flight delay and cancellation compensation, Flybe ONLY

    I hope someone can advise further. We booked to fly with flybe from man to edi, as we got out of our taxi at man I recieved a text stating that our flight had been cancelled. After speaking with customer services we were put on the next flight and told that our original flight had been cancelled due to crew sickness. The later flight we were put on was then delayed by 2h30m. I understand that this time wouldn't entitle us to any compensation, however my question relates also to the cancelled flight. I've read a few pieces of information; firstly it's all about how delayed you were in reaching your destination - in our case it was about 5h 20m late and also if they are offering you a new flight it's within a set number of hours - but ours wouldn't be within that as it was then delayed.

    I suppose my main question is do the cancellation and delay go together/can they go together to build the case? Do we have a case?

    For a romantic weekend away in edinburgh we've ended up with 8h30 delays as we were delayed with flybe on the return as well.

  • Just like to say a HUGE THANKYOU to Moneysaving Expert and the resolver web page ,easy to fill in and the 10 hour delay from Aberdeen to Birmingham 2 weeks ago has resulted in a £300 voucher for future flights !
    Very happy and made that sleeping on seats in departures worth it !

    As long as you re happy with vouchers that's fine. You can insist on cash!!!. How many of you were there? I would assume 2 which should be 500 euro compensation around £370 cash.

    Wonder if someone could help, I received this reply from flybe. Initially the flight was delayed due to fog but other flights then started taking off. Flights were then continuing to take off 4 hours before our delayed flight, which in total was delayed over 5 hours. Is it worth pursuing or a lost cause??



    Having investigated your claim, I must advise that we cannot consider any compensation request for this flight. The EU Regulation 261/2004, against which you are claiming, states that for compensation to be payable, the cause of the disruption has to be within the control of the airline.

    As this delay was the result of adverse weather conditions at Cardiff Airport which were incompatible with the safe operation of the flight, which we cannot be held responsible for, no compensation is due.     take off slots would be controlled by Air Traffic so still outside the airlines control...they can tell ATC they are ready and request a slot but they cannot just say "we're ready and leaving now" I expect that the flights that left before yours were possibly due to leave before yours originally....Flightstats should be able to confirm that
