Thanks - and yes, the mysterious amount is also why I was trying to clarify what they mean before I get back to them and ask for the full EUR600. It may be because I also claimed some expenses incurred for a taxi and luggage storage, but they're not clear about that. All they say is:

"... according to EU Regulation (EC) No. 261/2004, the compensation payments for flights departing from EU airport is a set limit (in line with other airlines). The distance of your flight, as calculated in accordance with EU legislation, is between 1500km and 3500km. Based on this, you are entitled to €400.00 in compensation, which is equivalent to £331.59."

I suspect that this is just bureaucratic error on their part - ask them which two destinations they are measuring: it aint Lon-Par, that's for sure!

    Morning,
following on from my post on 19 March, I have now received a further reply from BA.

"Thank you for contacting us. I apologise for the error made in our previous response.

I have reviewed your claim for compensation and your claim has been refused because flight BA1477 was delayed due to the unexpected flight safety shortcomings, which prevented the aircraft operating as scheduled. Under EU legislation, British Airways is not liable for a compensation payment in this situation.

Your flight was delayed as the aircraft suffered an oil leak from the engine number two and it required a replacement seal.

Unfortunately airline operations are subject to circumstances outside the airline's control. British Airways takes all reasonable measures to avoid delaying a flight in such circumstances. Consideration is given to whether there are any operational options available before a decision to delay is made. We are sorry that the delay was necessary in this case."

As this is being refused due to safety issues, can anyone please tell me if this is worth pursuing or not? Should this have been picked up during routine maintenance checks does anyone know? After all, we were actually boarded on the plane and left sitting on it for around 2 1/2 hours before it finally took off.

I appreciate any help that you can give me.
    Many thanks

So an oil leak is a safety issue! More like a technical problem I would say. Technical problems are not extraordinary and you are entitled to compensation. Just take them to court - forget the correspondence ping pong they are having a laugh. Don't forget to send NBA before you issue court claim.

Thanks for your reply, I have no idea what is classed as technical or safety issues!
    Much appreciated!
  • Hi all, I'm currently in dispute with BA over a cancellation in March from Barcelona back to Heathrow. I've already registered a claim with BA, but it has been rejected twice, as the flight was cancelled due to "adverse weather".

However being a Meteorologist, I know that my flight was not affected by any "adverse weather". The flight was due to depart Barcelona at 1720, and whilst there was "adverse weather" at Heathrow earlier in the day, morning fog, it had cleared by about 1030. I've provided BA with the forecast that was in issue at the time, which was for excellent weather, and the fog wouldn't have prevented the flight coming out to Barcelona either. BA told us about the cancellation in the morning, and we managed to re-book with Iberia via Madrid, without extra costs being incurred, but it did waste our day in Barcelona, and no food or drink was provided by BA.

Do any of you experts think its worth pursuing this further ?

Was this the 13th March by any chance. I would expect the issue with the fog to then turn to issues with Air Traffic restrictions. Heathrow has a very large volume of flights and when visibility is bad ATC will often restrict the numbers forcing airlines to cancel a number of their flights which they would have likely done at the start of the day. According to Flightstats yours was certainly not the only flight delayed that afternoon/evening
How much later did you arrive compared to scheduled time?

No idea. You could try putting the details into one of the calculators that some of the no win no fee firms put on their websites.

I assume this is just to ensure that they don't get sued if the information given happens to be wrong. They would never know what you used the information for - unless you told them.

Thanks Dave_e. The information was already there when we first checked around Feb time, but now seems to have gone? We were just going back to re-check something.. and we certainly never told them what we were doing...
