Looking for some advice here. My flight from Calgary > Heathrow > Glasgow was cancelled on Monday 11/12/17 by 24 hours. Even though, an Air Canada flight left 10 minutes after ours was scheduled to on the Calgary > Heathrow route, BA are still trying to claim weather was the issue.
From various news reports it has become apparent that BA's lack of de-icing facilities are to blame, as opposed to being the weather. With this in mind, I've out in a compensation claim to BA, which has been refused - they once again insist that weather is the issue, taking no responsibility.
I'm just wondering if anyone can tell me if I've got a leg to stand on here?
Thanks in advance for any help offered.
Hi Sam,
On this forum the feeling is that the more time that passes between an Extraordinary Circumstance (EC) event, such as the snow on Saturday, and a fight being delayed, the higher your chance of a successful claim.
This is because there is an obligation on the airline to prevent further flights being disrupted following an EC, which is where BA now seem to have left themselves open to claims such as yours.
In your case, I believe that you have a very good chance of a successful claim. However, the CAA have not clarified their position on this issue, which I believe is a derogation of their responsibility. This does not help the situation.
I also believe that a referral to CEDR may be too hit and miss, so on that basis I would push BA as far as you can, quoting from the regs etc, and then issue a LBA followed by MCOL proceedings against them.
It's not that difficult, and there is a very good guide written by on of our own experts which you should read. Just Google and download 'Vaubans Guide' and you will find all you need to start your claim.
There is a wealth of knowledge here to help with any further questions.

Hello, my flight from Inverness to London was cancelled on Sunday 10th after they held us in the airport for 7 hours, can I claim off BA for the hotel room I had booked for Sunday night in London, because I didn't get there?0

No, although you may be able to claim it from your travel insurance.0 -

Hi Tonyh66,
There is no provision in the EC261 regulations for claiming subsequent
losses.

After some advice for my in-laws...
They were on an American Airlines (sharing with BA) flight this morning from Miami to Heathrow (due 0840 arr 0855) Their BA transfer flight was due to depart to Glasgow at 1030.
They were due on the Glasgow plane but then told that BA had assumed they would not make the transfer flight so had sold their seats. They are now booked on a flight at 1705.
The flights were arranged by their cruise provider
Is there any scope for compensation in this instance?Everybody dies, but not everyone truly lives0 -
Hi parahandy,
Yes, if they presented at the departure gate within the specified time prior to departure and boarding was still open, they were involuntarily denied boarding (IDB) by BA.
Of course a sceptical view of this situation could suggest that as the flight to GLA was obviously oversubscribed BA sold their tickets to maximise revenue. This should not happen tho until the delayed passengers become a 'no show' by arriving at the departure gate after boarding has closed. At that point their tickets could be released to standby passengers hoping to board the flight.
There is virtually no defence to IDB, so they should use the BA website to put in a claim. If they had been on BA metal all the way from USA they could claim €600 each, however, because the first flight was on AA, BA may try to offer them only €250 for the short hall section only.

I would have thought even with the delay of 15 mins, 90 would have been enough time to transfer, especially if it was a straight thru codeshare ticket/journey?
At what point were they informed of the flight change? If you're new. read The FAQ and Vauban's Guide

AA56 is listed as landing at 09:19 yesterday which brought your in-laws well below the minimum connection time allowed for transfers between T3 and T5. I don't know what the legal situation is in these cases but it's entirely possible that BA's side of the story is correct. That said, I would have been pretty miffed if it happened to me.0 -
Wondering if I'm eligible to claim for what will be a 24 hour delay to our scheduled journey with BA from MAN to LHR and LHR to CAI yesterday. The flight from MAN was delayed due to baggage unloading issues on a previous flight at LHR so we arrived too late to make the connection at LHR. We have been booked onto the LHR to CAI flight at 17:35 today (24 hours after the original flight was due to leave).
Thanks in advance for any info0
