I’ve had a cheque in the post from Botts today but I didnt (knowingly) instruct them. I did use them to check eligibility. Could I have unwittingly instructed them or is this an attempt at instigating contact?
I’ve had several email with a button saying ‘click here to complete your claim’ but I’ve not pressed it.
Today’s letter says

Any ideas?0 -
When I used Bott & Co they emailed me some paperwork to electronically sign and send back.0

When I used Bott quite a few years ago I had to email my agreement at every stage then I had to give them bank details for the payment.
You must have filled in some sort of form at some point for them to have a postal address for sending the cheque. Bank it and appreciate that fact that you have won.0 -
Botts did indeed claim on my behalf. But they had the wrong email address and ageeed as I’ve not signed anything, they’re technically not instructed.
My options are bank the £335 (plus my husband has 335) or they will send the money back to Tui. In light of the fact Tui have already paid out, I’ll take my chances with them while I’ve still plenty of time. I estimate well get an extra £360.

I think you are asking for trouble. Tui might well say that the case is closed so far as they are concerned0

As its Botts who have, unusually, made the mistake, I think it is their responsibilty ethically and professionally to correct that mistake. They should be sending you the full amount.
You shouldn't have to sort out their mess.If you're new. read The FAQ and Vauban's Guide

I doubt we're getting the whole story. Simply using the eligibility checker would not provide Bott with a physical address.0

I did wonder about this, but when I spoke to Botts they said they could send the money back to Tui. And I guess, the fact that Tui gave it to them in the first place indicates that they have admitted liability?
I wonder if Botts would provide them with a cover letter? Stating they were not instructed!0 -

This would be ideal but not sure they would agree. I am calling back later, can’t do any harm to ask.0 -
So how does this work then with EC261/20040
