Mine took a few years, with all the stays, but like Vauban says its a long process...After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

Sally I'll tell you a specific lie that happened in my case. I had written to J2 asking for compensation they said no EC.
I said I'd ask the Spanish aviation authority to investigate, the AESA wrote to j2 and requested details of the delay. j2 wrote a letter to me saying that they were fully co-operating with the AESA investigation.
After six weeks the AESA ruled in my favour saying that j2 failed to respond to their enquiries.
In the Court defence, Jet2 stated that the AESA had not contacted them, not what they told me in a letter....
Ohh yes, they tell lies big time.

They'll serve the papers on Thomsons - and then inform you when Thomson have indicated they intend to defend. Then you'll get a copy of their initial (short) defence. And then you'll be sent an "allocation questionnaire", which is about putting the claim on the small claims track and (usually) your local court, with an invitation to mediation by telephone. Then you'll receive a hearing date from the court, with instructions on when to submit your papers to each other. The whole process will likely take about 6 months.

If I the airline simply say 'your not entitled to compensation because of an EC, hidden manufacturing defect' and you accept this as the truth, then this amounts to no claim, if you post the flight details I'll check for you if the flight is known to have suffered from such a defect, highly unlikely and I can assure you it's the airlines latest excuse to not pay passengers that have a genuine claim.

Well it's good news from me
With a flight in early 2009 and a declined claim in 2013 due to the 2 years I pursued Thomson in january via email and telephone to get an acceptance that the new reason of weather was on the previous flight. They wouldn't accept this.
So about ten days before the six years I issued an MCOL which was acknowledged not defended, I applied for judgement by default which was duly awarded.
Another series of phone calls commenced from me to Thomson and they agreed to pay the judgement by BACS, this didn't happen but yesterday i was told a cheque had already been raised. This arrived this morning.
So 400 euros ( at 2009 exchange rates ) + 8% interest for 6 years + MCOL fee
Well worth the little effort involved.

so I've just had a holiday with thomson with delays on both ways for long haul flights.
I've had a read of the guide but I'm unsure if I will have a case
the first leg, the plane was late landing(approx 1-2 hours) but they said there was a medical emergency on board, later on they realised they under fueled it so people who boarded had to exit, wait and board again. This led to a 5hour ish departure delay and we touched down just under 4 hours late. Any ideas how it works if only part of the delay was caused by exceptional circumstances?
At the time they refused to hand out any food/drinks vouchers as the plane wasn't going to be over 4 hours late, which it was. I had a meal in the terminal so i'm going to try to claim for that
The second was a 22 hour delay, they blamed bad weather diverting our plane on a previous flight(2 flights before ours) and they sent a replacement plane at the "earliest possibility". But I'm not sure if this meets the conditions of them doing everything possible to stop the delay.
I've sent through a template detailing the delays and waiting for them to comeback
so unfortunately I've not had any response from Thomson and will be sending my LBA.
Given that I am claiming for two delayed flights. Does anybody know if I should start two MCOL cases or combine them?
