  • I submitted a compensation claim to Thomson in June 2014 for a 5 hour delay on a flight from Manchester to Fuerteventura in March 2012. This was rejected by Thomson as the flight was more than 2 years ago.
    Following the Court ruling in October 2014 that claims could be made for delays within the last six years, I resubmitted the claim to Thomson.
    I finally received a cheque this week for £620 compensation from Thomson. :)
    I used the templates which were supplied on this website to put together my claim.

  • I posted here again recently when Thomson failed to respond to the Court order requesting they explain why their defence should not be struck out (post a stay based on Huzar).

    When the deadline passed I wrote immediately to the Court requesting Judgement. 2 days later a cheque arrived from Thomson for a lesser sum than I'd claimed, but dated before the deadline (and posted after the deadline expired). I calculated Thomson had used the current exchange rate and they showed interest at 4% on this lesser sum (but didn't include any calculations).

    I immediately wrote again to the Court enclosing a copy of Thomson's letter, their franked envelope dated after the deadline, and asking for Judgement on the balance.

    Today Judgement arrived from the Court with an instruction that Thomson must pay the balance 'forthwith' - because they failed to reply to the Claim form. This means I got the exchange rate at the date of the delay (2013) and interest at 8%.

    I have to reclaim the Hearing fee from the original Court (the case was transferred to Liverpool).

    So I would advise that if Thomson has been given a deadline by the Court, make sure you write to the Court immediately they miss the deadline so that you have the opportunity to ensure you are awarded the full amount of your claim.

    Thomson had plenty of time (a month) to send their cheque before the deadline (or indeed any time after Huzar) so I am very pleased with the Court's sensible Judgment.

    My experience:
    Based on my own experience it is a lot of administrative and research work to take a claim all the way through the Court process. It's very satisfying when you win, but if paperwork and research are not your strength then a NWNF firm may ensure you get something rather than nothing. There have been a few posts here recently where potential claimants have run out of time. If you think this might happen to you then think very carefully about the best way to handle your claim. However I'm very happy to be keeping all my Compensation.

    I submitted my claim on 17th Dec 2014, received a letter from them with the same response as the email automated reply on 19th Jan, when I phoned on Monday I was told I was on day 11 of my claim so presume that means for the 56 + days of the claim nothing was done, why send letters saying they will respond I 28 days when after 56 you still hear nothing, they are a shameful company and should be awarded the worst aftercare award.

    I wrote to Thomson via their website on 29th January with regard to our flight on 22 August 2009 using Martin's template letter.

    Our flight was delayed 6hr 38 mins from MAnchester to Cancun, travelling with me was my partner and son (child).

    Thomson have since replied to me saying:

    In order for us to fully investigate your claim under EU Regulations please can you provide the following information:

    BOOKING REFERENCE NUMBER
    LEAD NAME ON THE BOOKING
    DEPARTURE DATE
    OUTBOUND FLIGHT NUMBER
    RETURN DATE
    INBOUND FLIGHT NUMBER
    UK AIRPORT
    OVERSEAS AIRPORT
    AGENT/TOUR OPERATOR DETAILS

    Without this information, we will be unable to pursue your claim any further.

    Please ensure you attach a copy of your original correspondence in order for your claim to be assessed. Additionally, we must request that you also provide copies of your boarding passes and/or booking confirmation as evidence. Without this, we will be unable to process your claim.

    Can anyone advise re boarding cards? I only have boarding cards for myself and my son. My other half is likely to have binned his!

    I guess I can visit my local travel agent where I booked the holiday to see if they have the booking reference. But since they are Thomson they would only be telling me what Thomson can find out anyway...

    Any advice would be greatly appreciated.

  • Fairly standard stuff based on the legal maxim "He who asserts must prove". Send them copies of whatever you have got. Don't worry about boarding cards. Nobody keeps them. If they still refuse to deal with it sue them either yourself or through solicitors.

    I submitted my claim without boarding pass and received a cheque last week. I didn't have to provide any hard copies of anything, just reference numbers as per above and that's it.

    If you have a legitimate case, they are just using stalling tactics!!!!

    Having read this and posted I wonder if anyone can give me an idea of how to speed up this process?

    I submitted a claim on September 18th having returned from holiday on the 16th.

    Was told a cheque was issued on December the 11th (this never arrived)

    Was told another would be issued on January 2nd. This never arrived so I called to check, then I was told I needed to put in writing it never arrived. Then to be told it would take 28 days to put a stop on the original cheque.

    Still no nearer to knowing if / when we'll actually recieve this cheque.

    Does anyone know of anything we can do to get this moving as it seems we are being taken for a ride.
