    In my view (not a lawyer) you have to be careful about Finnair, as it relates to denied boarding - not delay. (And the legal point was about inequitable treatment between those allowed to board a plane, and those not.)

    The better argument relates to the Wallentin judgement, IMHO, and particularly the"Third Question".

    But if your hearing is on Monday, it's too late to start citing new authorities - you've already submitted your bundle presumably?

    Sturgeon said drlays in excess of three hours should be considered tantamount to a cancellation. But denied boarding is quite separate - ie the extraordinary circumstances defence in the original regulation specifically doesn't apply to denied boarding.

  • I have recently submitted a claim to Thomson. There were 3 passengers delayed from Larnaca airport. We were delayed for 4 hours and 13 minutes which takes us to the higher band of compensation at 600 euro per person. However, Thomson are claiming we were only delayed 3 hours 55 minutes which means we are only entitled to 300 euro per person as it's less than 4 hours. I have printed off confirmation of my flight delay being 4 hours 13 minutes from flight stats but they thomson claim it's only 3 hours 55 minutes. Where can I go from here? Is the flight delay information accurate from flight stats?
  • I submitted a claim in October for a flight delay in2009. Never received any answer from Thomson until a cheque for over £900 arrived by post today.

    After all the stress you have already been though it will not do you any good if you now find out that someone else from your flight has got compensation.

    I know how frustrated you were but you really might have to put it behind you now.

    We where delayed at Paphos airport for 5hrs55min, would imagine about the same distance, we got €400. Thought it was a longer flight than that to get €600
