    Not quite. Judge needs to agree it and that is certainly not a given as RPI has been well below 8%

    I've downloaded an article from Gov.uk which clearly states interest is "usually 8%".

    The usual rate of interest awarded by the court in this type of case is 8% but you need to plead it in the Particulars of Claim
  • Hi, am looking for fellow passengers who were delayed from Sharm el Sheikh 25th August 2011 into Manchester for 23hrs 50 minutes.
    I have just lodged a Small Claims and have received the usual over 2 years/extraordinary circumstance etc etc defence:mad:

    Bailey65 we were on that flight and made a claim last August before the 2 year cut off to avoid 'Dawson' being an issue. The case is being handled in Liverpool and was transferred there from Manchester. My claim has been linked with 1 other from that flight as at the time there was only 1 other claim that Thomson advised had been made in respect of the flight. The Court specifically asked if Thomson had received other claims for the flight. Maybe worth asking the Court to request if any other claims received for the flight to see what the response is!

    This does raise an interesting issue if once a claim has been submitted if you can request the Court at a later date to ask Thomson if there have been further claims

    Thomson have 28 days to appeal to the Supreme Court in the Dawson case. Is it the same for Jet2? Sorry if I have missed the details on here, I can't find info on it?
    Do we know if any of the appeals are lodged yet?
  • We flew with on a Thomson aircraft in Oct 2008 which was delayed for over 8 hrs due to a computer fault. The flight number was for a Thomas Cook flight. Having written to Thomson, on whode aircraft the fault occured they say: -

    [FONT=&quot]We can see from our internal flight reports that your outbound flight was originally operated by Thomas Cook. As part of the EU Regulation we have to look at the root cause of the delay to establish if compensation is due and in the case of your flight, we are unable to do this as the responsibility of the aircraft is with Thomas Cook. Therefore unfortunately we are unable to offer you any compensation and this is something you would need to pursue through Thomas Cook.

    We do not want to keep writing letters hence can anyone help as to which of the two companies are liable.

  • I suffered a delayed flight on 3rd August 2012 which was eventually rejected by thomson for unforseen circumstances etc in late 2013. I took this claim to the CAA and they ruled in my favour. I am now at a standstill becuase Thomson are not even replying to any letters or emails I send them. What would be my next port of call with the current stand off?

    Note: I have now lost all my paperwork as it was on my laptop which stopped working in January of this year (hard drive failure) and I didnt back it up DOH!

    Any help would be appreciated
