Have a look at the thread "Flight Delay Compensation Important Info - Please check before posting"0 -
When Thomson was granted a stay for Dawson in November they were instructed to notify myself and the court as soon as the result of the appeal was known.
I wrote to the court, copy to Thomson, after seven days of the appeal result being published stating Thomson had not complied with that instruction plus copies of both the Dawson and Huzar appeals enclosed. I also rather cheekily suggested Thomson now had no defense to my claim and that maybe the DJ would find in my favor!
Still nothing from Thomson and awaiting reply from DJ.0 -

The email states: "It is our considered view that the airline has not taken appropriate measures to avoid and or minimise the disruption. As such, in our opinion, the disruption to your flight is of a type which means that the airline should pay compensation.
We have given our view to the airline and have asked them to pay compensation to you as required in EC Regulation 261/2004. Our view on this case is based on the information provided to us, is not legally binding and only relates to the flight concerned. Currently the airline maintains their position that extraordinary circumstances applies and they are refusing to pay compensation. However, we are not an ombudsman scheme and we are unable to impose a solution on an airline."
I've wrote back to the CAA as Thomson has never provided any information regarding the "extraordinary circumstances" resulting in a four hour delay.
UPDATE:
I wrote to Thomson several weeks ago requesting compensation, citing the response I received from the CAA, as well as referencing the outcome of the Huzar case. They have now responded and the letter I received says: "I can see previously that we have responded to you in relation to your claim under EU regulation 261/2004. I can confirm that this will remain our final position and with that in mind, we're unable to offer any further comments or assistance in relation to your delay. It is with regret that we have been unable to resolve this matter to your satisfaction."
I'm obviously going to take this further. However, my concern is that while the CAA have responded positively and have "instructed" Thomson to pay compensation, I still do not know the circumstances surrounding the delay.0 -

Probably due to lack of sleep (that's toddlers for you!) and/or incompetence on my part, but could someone provide a link to the NBA letter? Thanks0
