    Is approaching the CAA worth it? In my case over a year after contacting them they have confirmed that in their view compensation is payable so arguably yes. However Thomson do not accept their findings and the CAA cannot do anything about it. Therefore what is the point of the CAA. My Court case is on hold pending Huzar but at least I have a bit of paper from the CAA confirming in their view I am entitled to compensation. Even if Huzar is over ruled then I can rely on Walletin and now the CAA in my Court bundle. I am sure Thomson would agree with the CAA if they thought no compensation was payable!

    But ... more people get their claim denied by the CAA than endorsed by it. And the CAA uses a broad list of technical defects which they consider "extraordinary" - even if the law doesn't.

    So given that the CAA letter won't persuade the airline to pay up, what is the advantage in waiting over a year, knowing that there is a 60% chance that they will side with the airline? If you're playing a percentage game, before the Huzar stay came into play, about 90% of those who started legal action got paid by the airline. That is not only way better odds but quicker too.

    People go to the CAA because it is easier to write them a letter than start legal action. But you have to do the latter eventually - and the chance of getting that "useful" letter from the CAA is less than evens (with the risk you hobble your case if they go the wrong way).

    Our case was stayed on Friday. The Barrister had to come all the way from London to Devon just to ask for the stay.
    Dawson being heard today, so I understand.
    Fingers crossed it goes the right way for the thousands awaiting its outcome.

    the flights that whole week were late to Sanford, we flew on the 26th and was told a plane 3 days earlier was hit by lightening, they seem to have a different excuse all week, they had to get a totally different plane for us and were delayed over 5 hours, it had a knock on affect all week.


    interesting one of the crew said a whole staff crew had striked/ walked out over cutbacks a few days before which was the true cause of the delay, I guess well never know, im submitting a claim anyway because 3 days before is not extraordinary circumstances, they should be able to sort it out not have flights lasted all week!

    Coincidentally I was on the same flight TOM046.

    When we went to check in our baggage we were told the delay was because the plane would not start and we would not be flying on the Dreamliner as originally booked. When I asked when they knew about it she replied yesterday (25th April).

    She handed me a letter about being compensated for premium seats but that did not apply to us. After looking at the letter it does state a technical fault in the fleet but actually refers to a different flight TOM086 25th April.

    I heard about lightning strikes but that was from other passengers so I cannot be 100% sure. All I can go on is what I was told that it was a technical fault.

    I plan on claiming for myself and 5 others in our group. Sitting around for 8 hours in an airport with a 4 year old and a 6 month old baby is not my idea of fun and the £4 voucher we were given barely buys a coffee at airport prices!

  • they did twilight check in the night before so that's why they didn't know anything about it or get any letter :-(


    ill let you know if we get any joy with out claim, they still haven't refunded any money as promised for the downgrade, despite being told a cheque was on its way.
