One quick question: is the Judge obliging the airline to disclose any payments to others in relation to 261/04 claims for the same flight or only those which gave rise to formal legal action (either concluded, or settled before judgement)?0 -
Hi all, I have started claim proceedings and have received Thomson defence (2 yrs and extra-ordinary circumstances). I am submitting my evidence using information gleaned from, predominately Vauban and Centipede, (now four pages) citing Sturgeon/Wallentin/More and making reference to Dawson. Do I need to send full copies of the judgements of all of four cases along with my evidence?? Or do they get provided in the bundle to Court once a hearing date has been issued?

You will be given instructions from the court about when to send your bundle of evidence. This comes often at the same time you get your hearing date (it's called an "Order" from the court).
You will need to submit all the judgements and other evidence in your bundle. Take a look at my write-up of my experience against Monarch, if not already seen. There's a link in the court success thread, I think. I list the documents I submitted in there.0 -
Hi I have just received the usual response from Thomson regarding the Montreal Convention 2 year ruling for a flight I was on with my family in 2010 which was delayed over 3 hours.I forwarded it to the CAA.What do I do next please? or do I sit tight and wait0

There's quite a few threads on what to do next if you search the forum scooby.
Waiting a year for the CAA to reply isn't one of the options lol0 -
my hubby and son were also affected by the delayed flight to Florida today and suffered a delay of nearly 6 hours, apparently 3 days ago a plane was hit by lightening ,or that's the official line, one of the staff was heard telling a passenger that it was cos they had made staff redundant and a crew had walked out???
either way .......3 days later its still having knock on affects, they cant claim this as extra ordinary circumstances?
also the plane was switched and they paid for premium which wasn't on the new plane, can we claim this and the compensation...?5 kids..1 hubby...1 dog..3 rabbits and a goldfish...yep ours is a Madhouse

Sent email yesterday regarding above flight delayed 5 hours, both my children were on the flight visiting friends in Calgary. Only waited till today before Thomas Cook sent me reply ans asked for further proof that they travelled on the flight, had kept emails regarding booking (sad i know). I emailed all the information and got a reply back 30 minutes later saying that the flight was delayed due to technical fault and hence wasnt covered under the rules. So going to send details to CAA and see what happens.....;)0
