Thomson sent a copy of their defence to us dated 4th April 2010 but received mid-day on 9th April 2010 unsigned! This was one day late for submission to us. Interestingly the CCMCC forwarded a copy of the same Thomson defence to us dated 4th April 2010 but received 10th April 2010.
This copy, although signed, appears to be a "carbon copy" signature. It is as though a copy of the defence was signed (maybe for CCMCC) with a carbon placed between two copies of defence and we received the one with the carbon signature! Is this legal?
You won't be able to make much headway with the Court over a 1 or 2 day late submission.
I would imagine that a carbon copy signature is just as legal as a photocopied one although I really do not know if a photocopied signature is legal either.
Are the dates you have mentioned correct or have I just woken up after living in a virtual dream world for what seemed like four years?

Afternoon,
Newbie here.
Just been on the phone to Thomson (nightmare to get hold of the one single person who can help).
They say they cannot honour my claim as my flight was in 2010 and their company policy is a maximum of 2yrs. Is this true?
I have done some searching on the forums prior to posting and found a few bits and pieces but nothing that categorically stated yes or no if this is correct.
Any help or pointers in the right direction appreciated.

Oops! Yes the date should be 2014! I was fixed on 2010 and will certainly pay more attention in future.0 -

Hi can any one tell me if they were on this flight which was delayed over three hours flying from gatwick in to Sanford Orlando. Have sought flight delay for this and been fobbed off with extraodinary circumstance but not one that I have come across on these pages. Health and safety concerns and replacement crew needed to be sourced for the flight. Do not know if I have a case but have just sent letter to Thomson asking them to give me a defence as to what the reason for the delay was as the response is way to vague for my liking, we was not informed of any rights at the airport and was not issued with any letter, text for the delay or compensation I may be able to claim. Any guidance would be appreciated0

Thanks for the info I have had quite a long look at the threads on this forum and have already decided to take the matter further, and even though I have only just sent my letter off to Thomson my nba is already written as I don,t hold out much hope of getting the truth from them. I just wondered if any one had been giving this response fron Thomson before, regarding health and safety needing replacement crew our flight was due to leave at 09:15 so can not se why crew were unavailable.0

So what's the latest on Thomson? They still playing the hardest ball?
Time has marched on and they are of course hovering above the jaws of the Crocodile.
The Dawson appeal is less than a month away now. So what are people's thoughts on the verdict? I think Thomson will fail epically.
BUT! If they do is that really the end of it for all of us who have been stayed? Will they simply appeal the appeal decision?0 -
My claim is in respect of delayed flight TOM 093 on 1st August 2013 from Cancun to London Gatwick with the scheduled departure time of 16:15 hours (Cancun time). This flight departed 22:50 hours late. I have filed a small claims application in the County Court and we have just exchanged Directions Questionnaires.
Thomson rely on unforeseen and unavoidable technical faults, namely 'bus isolation faults'. At the time of the original delay, and prior to boarding, the Captain advised that a problem with the plane’s air conditioning system was the cause of the delay. No mention was made of “bus isolation faults” or any other power supply issue.
We were put up overnight in sub-standard accommodation. We were transported back to the airport the following day and told that our flight would was scheduled for departure at mid-day (Cancun time). The Captain reappeared and told us that he had never been so embarrassed in his whole life as he explained that the plane was ready to go, but now had no food. He said that they had been promised catering from local suppliers by mid-day, but that this had not yet arrived.
We finally departed some 23 hours late. On the plane, the First Officer told passengers that the catering had been on the plane, but the local staff had claimed that it had thawed out and was unusable. He said that he believed that it had been stolen by the local Mexican staff. He explained that technically the plane had been ready to fly at midnight (Cancun time). The whole of the 15 hour delay therefore on that second day, 2nd August 2013, was due to the loss of the food on the plane and nothing to do with the original cause of the delay, whatever that may have been.
I put my case to the Civil Aviation Authority and they have written to me confirming that they had advised Thomson that they cannot rely on the ”extraordinary circumstances” exemption under the Regulation and should pay the compensation that we have claimed.
Apologies for the lengthy post (I have edited it down honest!). Thomson's customer care has been woeful, actually, based on my experience, they just don't care. I would be grateful for any advice that may help me in my case and will post updates.
