Flight delay and cancellation compensation, Tui/Thomson ONLY

  • Hi all, my girlfriend and I were delayed both to and from our holiday. Should it go to court can I claim for both delays for both of us? Or each to our own? Or treat each delay as a separate claim?

    Read the FAQs and use the search facility for anything specific. If you don't want to do that, contact a no win no fee firm.

    Hi I have completed form N1 and have received Thomson's defence (standard per all other cases on this site). The parties that I named were myself, wife, my son and his friend. I bought and paid for all four tickets but named us all on the form. However, correspondence is being sent directly to my son's friend (who is now 20) and has nothing to do with the claim apart from he was on the flight and named by on the form. Can I send a letter to the court to ask for all correspondence to be addressed to me. Also, the four individuals named have received the Directions questionnaire and the Mediation Service Form. Do we all need to complete and return or I am able to do this on behalf of all of us as the Claimant. Furthermore, can I also request in a letter that (if it comes to it) my wife represents us all in Court (as she has been handling this case and has more time than me. Many thanks

    The compensation is due to the passenger, not the person that paid for the flight so, if successful, I believe they will issue a cheque to your sons friend for his compensation
  • Ive sent off the template letter, had their standard nonsense letter back, montreal convention etc etc.

    Now its become a battle of wills!

    Just filled out the online form to the caw.

    What else can i do? Anything?

    Thomsons sheer arrogance about the whole matter just puts me off ever booking with them again to be honest.

    Hi i have been looking on this site for a while, I contacted Thomson regarding my 11 hour 50 minute flight delay and was fobbed of with "oh its lapsed over 2 years so there's nothing we can do!"
    I therefore followed the guidance on here and after getting knowhere with Thomson i wrote to Agencia Estatal De Seguridad Aerea in Madrid. They have responded in my favour as Thomson have failed to correspond with them and i'm now wondering what my next step should be!
    I've looked at the FAQS and i'm unsure of which step to take next!!
    Any advice would be greatly appreciated

    Either you or a NWNF to issue NBA then take airline to court.

    We had a flight delayed in 2008. Supposed to take off from East Mids around 11.00am but we actually took off at 6.30pm that day to Palma Majorca. Because Thomson keep quoting this 2 year rule, I requested they send me all info from this flight including a letter I wrote complaining to them after our holiday. I paid £10 for this under the Freedom of Info Act. If I had a copy of this letter then they can't wriggle out of compensation saying you need to get in touch within 2 years of the flight because I actually did!

    Now get this - they sent me a copy of a letter I'd sent them in 2006. I really can't remember this but we'd apparently been delayed in that year too. That time though we flew from Birmingham. The odd thing is though that the letter they sent me a copy of was a complete mix of the letter I'd sent in 2006 with paragraphs from the letter I sent in 2008!!! I know this is a fact because I mention all sorts of things about the 2008 delay in the letter they sent me, including the fact it was a French jumbo jet and not a Thomson plane and the awful plane food we were given. It is the only time ever when we have flown with Thomson that we haven't flown on a thomsonfly plane!!!

    babelfish - depending upon when your 2008 flight was you could be sailing very close or already past the 6 year threshold. If you want to pursue you are best to start court action NOW - if you are not already too late.
