as haven't got time to read all 239 post and not really sure how to search on this forum

Your best bet would be a no win no fee firm in that case. It's a time consuming business to manage a claim yourself.

Thompson has again refused to compensate due to the 2 year period. I am sure this is wrong and complaints can go back up to 6 years. Where should i go from here as I'm not sure how to proceed with this. Any help would be appreciated.
    Thanks

  • Hello

Thankyou to those with the advice regarding the card chargeback, the card company have said that if i can prove the flight was delayed through the airlines fault they maybe able to help, but the payment is no longer on hold.

I have spoken to Thomson today and they confirmed the fault was technical dual navigation screen faliure, they say that because the plane was maintained that this problem is extraordinary, and i can not be compensated, they wouldnt confirm if dual screen faliure is a manufacturers fault or not?

over all i was really dissapointed with the customers services they really do not seem to care, so now i could do with knowing which NWNF company to chose who will take Thomson on IF the techincal fault is not extraodinary, can anyone clarify?

    many thanks

    Hello

I've received a response from Thomson saying the cause of my 12hr 35min delay (flight TOM039 scheduled to depart Cancun to London Gatwick 5 November 2012) was:

"a delay due to another aircraft caused by an "unexpected flight safety shortcoming" arising from the discovery of a technical defect that doesn't fall into the category of something that was or ought to have been discovered during routine maintenance"

I was wondering if anyone else had received the same response?

My head melts a little when I try to digest all the legal references :(

This is my first ever post in a MSE Forum, not even sure I'm doing it right?

yes i had the exact same response, uncanny as my delay was this feb! so i was correct when i accused Thomson of sending unpersonalised standardised excuse letters (you know all the main political parties have the same letters no matter what they believe! shockng!) i phoned today to find out what the actual fault was and was told it was a dual navigation screen faliure, and out of their control, extraordinary circumstance..

i think i am growing more concerned with HOW MANY flights have technical faults especially with the missing Malysian flight :(
  • do any of you enlightened one`s know how I can get info for my delayed flight going back to December 2010. flightstats? don't go that far back. it was a (UK) departure time of 09:00 sunday but departed 00:28 Monday, 15+hrs late, and arrival time of aprox 15:45 (local) sunday, but landed aprox 07:00 (local ) Monday morn aprox 15hrs late!.
I think I have a fight on my hands, no boarding pass/ticket.
who would of kept them? :rotfl: however the kind people at the UK airport have confirmed the departure time of 00:28.

You are assuming that the "actual fault" was actual, and perhaps not another cut n paste job......? :D

After 20 months of emailing, Thomson have finally sent a cheque equivalent to €400 per person for a 5 hour flight delay on a Rome to Manchester flight in July 2012. Initially they claimed exceptional circumstances but have now said the delay was due to operational issues and therefore under the EU ruling we are entitled to compensation.

I have just received compensation for a flight delay in 2012. Thomson didn't ask for the boarding cards even though I had them. They asked me to provide the flight number, booking reference, lead name, airport departed and arrived and the flight times.

    Hi all,

just wanted to give a little update on my claim. I posted back last April/May about being delayed in 2012 for 5 hours from Gatwick to Liberia Costa Rica. My original claim to Thomson was shot down with 2 or three contradicting reasons as to why the flight had been cancelled and why i wasn't due any compensation.
After a few posts on here i decided to go the CAA with my complaint as i wasn't confident enough to pursue it on my own. I was told there was an 8 week delay on responding to cases. Well 10 months later I have just had a phone call from the CAA saying my check for 1200€ (£1005) was in the post!! Apart from the long wait it really was hassle free and I am so glad it went in our favour in the end!

Good luck to everyone else still waiting! :)
