NO (dependant on Thomson v Dawson in May). look in FAQ's it will give you all the advice on 2 (or 6) year Limit.

Read Legal Magpie's reply, Camaro: the OP is too late either way, as it happened more than 6 years ago.

Yes you can but currently subject to Dawson appeal. Read up and you will understand.

The posts that were made in the hour before you posted ask the same question. Look at the 3 posts above yours.

    Hi all..

My case has been allocated to the Small Claim track following the allocation from been sent to the court.

I thought I would be asked to submit my papers, or some from of argument. The only claim the court has had form me is the few lines you can submit on the MCOL from..

    Think my question is:
    1) Will I be asked to submit my argument before the date
    2) If not, can i submit my argument and evidence to the court before the date? I don't want to read i line by line in court..

    Thanks

Once it has been allocated to a specific court on the small claims track, you will received an order from the Judge giving you a) the time and date of the hearing and b) an instruction on when to submit papers (to the court and with each other).

Well that is odd - give the court a ring and ask. Generally, the convention is no later than a fortnight beforehand.

What sort of hearing are you scheduled for? What exactly does it say in the order?
  • Hello, I want to take Thomson Airways to small claims court after their refusal to pay flight delay compensation. Do you know please if I am liable for their defence costs should I lose.
